BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order
Chairman Corradino called the meeting to order at 12:00pm.
Chairman Corradino called the roll call, 9 appellants were present, 1 appellant was absent, State Issuing Authority was present, 2 local Issuing Authorities were present and 2 local Issuing Authorities were absent.
Chairman Corradino read the Introductory Statement and Administered the Oath to all witnesses.
Board Members Present: Mr. Arthur Carr, Chairman Joseph T. Corradino, Esq., Chief T. William Knapp (Ret.), Mr. M. Peter Kuck, Colonel Kyle E. Overturf and Mr. Kenneth V. Tramadeo.
Board Members Absent: none
Cases scheduled for hearings:
1) Case No. 11-23-D, Phillip Magruder, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Detective Sergeant R. Pekrul represented the local Issuing Authority, Chief Jeffrey W. Cossette, Meriden Police Department.
Decision: By a unanimous decision, the Board members voted to overturn the decision of the local Issuing Authority, Chief Jeffrey W. Cossette, Meriden Police Department and voted for Mr. Magruder to be issued a temporary pistol permit.
2) Case No. 11-35-D, Reinadlo Collazo-Torres, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. A representative of the local Issuing Authority, Chief Lisa Maruzo-Bolduc, Willimantic Police Department failed to appear.
Decision: By a unanimous decision, the Board members voted to overturn the decision of the local Issuing Authority, Chief Lisa Maruzo-Bolduc, Willimantic Police Department, by default for the failure to appear. The Board voted for the appellant to be issued a temporary pistol permit.
3) Case No. 11-133-R, Alexander Zatserkovniy, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Barbara Mattson represented the Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.
Chairman Corradino made a motion in favor of the appellant, Kuck seconded the motion.
Chairman Corradino made a motion to table his first motion, Knapp seconded the motion, Carr, Corradino, Knapp, Overturf and Tramadeo voted for the motion. Kuck opposed the motion. Motion carried.
Decision: By a unanimous decision, the Board members voted to overturn the decision to revoke, of the Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection and for Mr. Zatserkovniy to be reinstated his pistol permit.
4) Case No. 10-280-R, Scott Cathcart, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Barbara Mattson represented the Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.
Resolved: Detective Mattson representing the Issuing Authority, Commissioner Reuben F. Bradford, informed the Board that the appellant Mr. Cathcart had been reinstated his permit prior to the hearing.
5) Case No. 11-75-R, Mark Mortagua, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Barbara Mattson represented the Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with one witness.
Decision: By a majority, the Board members voted to uphold the decision of the Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, the revocation of Mr. Mortagua’s pistol permit, at this time. Carr, Corradino, Knapp and Overturf voted for the Issuing Authority. Kuck and Tramadeo voted for the appellant.
6) Case No. 10-134-R, Christopher Berg, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Barbara Mattson represented the Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with one witness.
Decision: By a majority, the Board members voted to uphold the decision of the Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, the revocation of Mr. Berg’s pistol permit, at this time. Carr, Knapp, Overturf and Tramadeo voted for the Issuing Authority. Corradino and Kuck voted for the appellant.
7) Case No. 11-122-R, Stephen Epifano, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant failed to appear. Det. Barbara Mattson represented the Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection with one witness.
Decision: By a unanimous decision, the Board members voted to uphold the decision of the Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection, by default due to Mr. Epifano’s failure to appear.
8) Case No. 11-67-R, Hector Vazquez, Jr. involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Barbara Mattson represented the Issuing Authority, Commissioner Reuben F. Bradford, Department of Emergency Services and Public Protection.
Motion: Chairman Corradino made a motion to dismiss, due to a State Statute disqualifier on Mr. Vazquez’s arrest history which prevents him from possessing a pistol or revolver. Knapp seconded the motion, motion carried.
9) Case No.11-127-D, Cory Francis involving the denial of a temporary pistol permit to carry pistols and revolvers. Attorney Ralph D. Sherman represented the appellant with four witnesses. The local Issuing Authority, Chief Thomas J. Sweeney, Glastonbury Police Department, appeared with three witnesses.
Decision: The Board members vote was tied which results in the appellant’s favor. The local Issuing Authority, Chief Thomas J. Sweeney’s decision to deny is overturned and Mr. Francis is to be issued a temporary pistol permit. Corradino, Knapp, and Overturf voted for the local Issuing Authority, at this time. Carr, Kuck and Tramadeo voted for the appellant.
10) Case No. 11-60-D, Jaime Polite, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. A representative of the local Issuing Authority, Chief Frank Limon, New Haven Police Department failed to appear.
Decision: By a unanimous decision, the Board members voted to overturn the decision of the local Issuing Authority, Chief Frank Limon, New Haven Police Department, by default due to a failure to appear. The Board voted for Mr. Polite to be issued a temporary pistol permit.
Secretary’s Report:
1) Carr made a motion to approve the July 28, 2011 minutes as written. Tramadeo seconded the motion. Overturf abstained. Motion carried.
2) Secretary Knapp stated that although the election for Secretary took place at the last meeting, his term starts on August 11, 2011 for a period of two years.
Motion to adjourn: Tramadeo made a motion to adjourn, Kuck seconded the motion, motion carried. Meeting adjourned.
