A. Call to Order

Chairman Corradino called the meeting to order at 12:00pm and called the roll call of appellants and Board Members.

12 appellants were present and one appellant was absent.

Board Members Present: Mr. Arthur C. Carr, Chairman Joseph T. Corradino, Esq., Chief T. William Knapp (Ret.), Mr. M. Peter Kuck, Colonel Kyle E. Overturf, Mr. Kenneth V. Tramadeo.

Board Members Absent: none

Chairman Corradino read the Introductory Statement and Administered the Oath to all witnesses.

Cases scheduled for hearings:

1) Case No. 10-213-R, Cyril Steer, involving the revocation of his State pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Andrew Matthews, represented the Issuing Authority, Commissioner Reuben F. Bradford, Department of Public Safety.

Withdrawl: The appellant withdrew his appeal without prejudice.

2) Case No. 10-256-R, Tony Mann, involving the revocation of his State pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Andrew Matthews, represented the Issuing Authority, Commissioner Reuben F. Bradford, Department of Public Safety.

Withdrawl: The appellant withdrew his appeal without prejudice.

3) Case No. 10-162-R, Manuel Cruz, involving the revocation of his State pistol permit to carry pistols and revolvers. Attorney Ralph D. Sherman represented the appellant.  Sgt. Andrew Matthews, represented the Issuing Authority, Commissioner Reuben F. Bradford, Department of Public Safety.

Agreement: The appellant, Mr. Cruz and the State Issuing Authority, Commissioner Reuben F. Bradford, Department of Public Safety, agreed the appellant will be reissued his permit on December 3, 2011, so long as there are no other events that are detrimental to his suitability

4) Case No. 10-199-R, Santo Bazzano, involving the revocation of his State pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Sgt. Andrew Matthews, represented the Issuing Authority, Commissioner Reuben F. Bradford, Department of Public Safety with one witness.

Decision: By a majority, Board members voted to uphold the decision of the Issuing Authority, Commissioner Reuben F. Bradford, Department of Public Safety. Carr, Corradino, Knapp, Overturf and Tramadeo voted for the Issuing Authority. Kuck voted for the appellant.

5) Case No. 10-188-R, Frank Bailey, involving the revocation of his State pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf with one witness.  Sgt. Andrew Matthews, represented the Issuing Authority, Commissioner Reuben F. Bradford, Department of Public Safety with one witness.

Decision: By a majority, Board members voted to overturn the decision of the Issuing Authority, Commissioner Reuben F. Bradford, Department of Public Safety and voted to reinstate Mr. Bailey’s pistol permit. Carr, Knapp, Kuck, Overturf and Tramadeo voted for the appellant. Corradino voted for the Issuing Authority.

6) Case No. 10-215-R, Timothy Phillips, involving the revocation of his State pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Andrew Matthews, represented the Issuing Authority, Commissioner Reuben F. Bradford, Department of Public Safety.

Decision: By a unanimous decision, the Board members voted to uphold the decision of the Issuing Authority, Commissioner Reuben F. Bradford, Department of Public Safety by default, due to the appellant's failure to appear.

7) Case No. 10-191-R, James Coleman, involving the revocation of State his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Sgt. Andrew Matthews, represented the Issuing Authority, Commissioner Reuben F. Bradford, Department of Public Safety.

Withdrawl: The appellant withdrew his appeal without prejudice.

8) Case No. 10-196-R, Charles Bado, involving the revocation of his State pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Sgt. Andrew Matthews, represented the Issuing Authority, Commissioner Reuben F. Bradford, Department of Public Safety.

Agreement: The appellant, Charles Bado and the State Issuing Authority, Commissioner Reuben F. Brandford, Department of Public Safety, agreed the appellant will be reissued his permit the next day, April 15, 2011.

9) Case No. 10-214-D, Charles Smith, involving the State denial of his non-resident pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Seth Mancini represented the Issuing Authority, Commissioner Reuben F. Bradford, Department of Public Safety with one witness.

Decision: By a majority, Board members voted to overturn the decision of the Issuing Authority, Commissioner Reuben F. Bradford, Department of Public Safety and voted to reinstate Mr. Smith’s pistol permit. Carr, Corradino, Kuck, Overturf and Tramadeo voted for the appellant. Knapp voted for the Issuing Authority.

10) Case No. 10-233-R, Carl Hazen, involving the revocation of his State pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Seth Mancini represented the Issuing Authority, Commissioner Reuben F. Bradford, Department of Public Safety with one witness.

Decision: By a unanimous decision, the Board members voted to overturn the decision of the Issuing Authority, Commissioner Reuben F. Bradford, Department of Public Safetyand voted to reinstate Mr. Hazen’s pistol permit.

11) Case No. 10-250-R, Peter Oschmann, involving the revocation of his State pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Seth Mancini, represented the Issuing Authority, Commissioner Reuben F. Bradford, Department of Public Safety with one witness.

Decision: By a unanimous decision, the Board members voted to uphold the decision of the Issuing Authority, Commissioner Reuben F. Bradford, Department of Public Safety.

12) Case No. 10-229-D, John Kruvka, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. William Warner, represented the local Issuing Authority, Acting Chief Patrick McMahon, Middletown Police Department.

Decision: By a unanimous decision, the Board members voted to overturn the decision of the local Issuing Authority, Acting Chief Patrick McMahon, Middletown Police Department and voted for Mr. Kruvka to be issued a temporary pistol permit.

13) Case No. 10-284-D, Anthony Chadwick-Coppola, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Chief Neil Dryfe, Cheshire Police Department was present as the local Issuing Authority.

Decision: By a majority, the Board members voted to uphold the decision of the local Issuing Authority, Chief Neil Dryfe, Cheshire Police Department, at this time. Carr, Corradino, Knapp, Kuck, and Overturf voted for the local Issuing Authority. Tramadeo voted for the appellant.

Secretary’s Report:

1) Tramadeo made a motion to approve the March 24, 2011 Minutes as written. Knapp seconded the motion, Motion carried. Corradino and Overturf abstained.

Motion to adjourn: Overturf made a motion to adjourn, Kuck seconded the motion, motion carried. The meeting adjourned at 5:45pm.
