In the Matter of a Complaint by

     Respondent
November 14, 2012

     The above-captioned matter was scheduled to be heard as a contested case on October 9, 2012 at 2:00 P.M., at which time the respondent appeared, but the complainants did not appear to prosecute the case.  The hearing officer notes that counsel for the respondent appeared with two witnesses who were prepared to testify at the contested case hearing.  The hearing officer is not aware that the complainants requested that the contested case hearing be rescheduled, or in any way informed the Commission that they were unable to appear on October 9, 2012.
     The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
     1. The complaint is hereby dismissed.
     2. The complainants are admonished for their failure to appear at the hearing in this matter, which failure resulted in a waste of scarce state and local resources.
