Final Decision FIC2011-502
In the Matter of a Complaint by
FINAL DECISION
Frando Webb,
     Complainant
     against
Docket #FIC 2011-502
Chief Court Administrator,
State of Connecticut, Judicial Branch; and
State of Connecticut, Judicial Branch,
     Respondents
May 30, 2012

The above-captioned matter was scheduled for hearing as a contested case on February 1, 2012, at which time the complainant failed to appear. The Commission maintains a record from the U.S. Postal Service indicating that the Commission’s order to show cause was delivered at the last known address of the complainant on December 23, 2011.
The respondents appeared at the hearing and presented exhibits and argument showing that the complainant received records responsive to his request on two separate occasions. Because the complainant changed addresses, the respondents had to make an extra effort in order to provide responsive records to him.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
     1. The complaint is hereby dismissed for failure to prosecute.
Approved by Order of the Freedom of Information Commission at its special meeting of May 30, 2012.
