In the Matter of a Complaint by

May 30, 2012

     The above-captioned matter was scheduled for hearing as a contested case on February 1, 2012, at which time the complainant failed to appear. The Commission maintains a record from the U.S. Postal Service indicating that the Commission’s order to show cause was delivered at the last known address of the complainant on December 23, 2011.
     The respondents appeared at the hearing and presented exhibits and argument showing that the complainant received records responsive to his request on two separate occasions. Because the complainant changed addresses, the respondents had to make an extra effort in order to provide responsive records to him.
     The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
     1. The complaint is hereby dismissed for failure to prosecute.
