The above captioned matter was heard as a contested case on December 13, 1978, at which time the complainant and the respondents appeared and presented testimony, exhibits and argument on the complaint.
After consideration of the entire record, the following facts are found:
1. The respondents are public agencies within the meaning of §l-18a(a), G.S.
2. By letter the complainant requested a copy of a report of an investigation carried out on or about July 6, 1977 from the respondent chief of police.
3. The requested documents not having been provided, the complainant filed his appeal with the Freedom of Information Commission on October 12, 1978.
4. Some of the documents pertaining to the investigation were provided to the complainant.
5. At hearing it was stipulated that the records which the complainant desires are (1) a copy of an internal affairs report by Sgt. Frederick Morrow, and (2) a copy of an application for an arrest warrant which was submitted to the 7th G.A. in Meriden, July 19, 1977.
6. The respondents claimed that even though the requested records are not reports concerning the investigation of a crime they are exempt from disclosure because such reports could place a police officer in a bad light.
7. It is found that the requested records are not exempt from disclosure under §l-19(b), G.S.
8. It is concluded that the requested records are subject to disclosure under §l-19(a) and §1-15, G.S.
The following order by the Commission is hereby recommended on the basis of the record concerning the above captioned complaint:
1. The respondent police chief shall forthwith provide the requested records to the complainant.
