The above captioned matter was heard as a contested case on November 20, 1978, at which time the complainant and the respondent university appeared, stipulated to certain facts, and presented testimony, exhibits and argument on the complaint.
After consideration of the entire record, the following facts are found:
1. The respondent university is a public agency as defined by ยง1-18a(a), G.S.
2. The complainant requested certain medical records from the respondent university by letter dated September 27, 1978.
3. Having failed to receive a reply within four business days, the complainant appealed to this Commission by letter filed on October 4, 1978.
4. The respondent university does not keep and maintain the requested records.
5. It is therefore found that the complainant has not been denied access to such records within the meaning of the Freedom of Information Act.
6. It appears that the requested records are kept by the Veterans Administration Hospital, Newington, Connecticut.
7. Such hospital is operated by the Veterans Administration, a federal agency.
8. The Freedom of Information Commission is without authority to order the disclosure of records kept by an agency of the federal government.
9. The complainant must pursue any rights of access that she may have to the requested records under pertinent federal law.
The following order by the Commission is hereby recommended on the basis of the record concerning the above captioned complaint:
1. The complainant is hereby dismissed.
