The above captioned matter was first heard as a contested case on October 26, 1979 and continued to November 3, 1978, at which time the complainant Norwalk Hospital and the respondent appeared and presented testimony, exhibits and argument on the complaint.  William Backus Hospital withdrew as a complainant in this matter by notice filed with this Commission on October 26, 1978.

      After the aforesaid hearing, the parties reached an agreement whereby the matters in controversy have been settled to their mutual satisfaction.   Consequently, the parties have agreed that the complaint herein may be dismissed.

      The following order by the Commission is hereby recommended on the basis of the record concerning the above captioned complaint:

      1.  The complaint is hereby dismissed.
