In the Matter of a Complaint by

     Respondents
November 29, 1978

    

         The above captioned matter was heard as a contested case on November 3, 1978, at which time the complainant and the respondents appeared and stipulated to certain facts.
         After consideration of the entire record, the following facts are found:
         1. The respondents are public agencies as defined by §l-18a(a), G.S.
         2.  By letter dated July 26, 1978, the complainant requested a copy of the total expenditures of monies used for conducting a certain election.
         3.  Having failed to receive compliance within four business days, the complainant appealed to this Commission by letter dated August 9, 1978 and filed herewith on August 14, 1978.
         4.  The respondents did not conduct the election in question but rather it was conducted by the Judea-Christian Women's Association; a non-profit group, which group paid the costs thereof.
         5.  Such group has asked for a voluntary contribution from the respondents in return for conducting the election.
         6.  At the time of hearing, the respondents had not yet agreed to the amount of the contribution.
         7.  The complainant is seeking, and the respondents have agreed to provide, the amount of any contribution at such time as the respondents determine the amount thereof.
          The following order by the Commission is hereby recommended on the basis of the record concerning the above captioned complaint:
         1.  The complaint is hereby dismissed subject to the agreement of the parties as outlined in paragraph 7 of the findings above.
