FINAL DECISION

and Hartford Public Schools,
     Respondents
September 10, 2014

     The above-captioned matter was consolidated for hearing with Docket #FIC 2014-014; also captioned Michael Fryar v. Superintendent of Schools, Hartford Public Schools; and Hartford Public Schools. Both matters were heard as contested cases on August 6, 2014, at which time the complainant and the respondents appeared and presented testimony and argument on the above captioned complaint.
     At the hearing, the complainant reviewed, with respondents’ counsel notations on a record that had been produced to him in response to his March 13, 2014 request. This review caused a technical discussion concerning information technology between the parties, which included Marco Morales from Help Desk Support at the respondent, Hartford Public Schools. Respondents then produced a not yet disclosed additional record, which the complainant inspected. Following this inspection, the complainant stated that he wished to withdraw his complaint.
     The following orders by the Commission are hereby recommended on the basis of the record:
     1.  Based on the withdrawal of the complaint, the case is hereby dismissed.
     2.  The Commission commends both parties on the conduct of a professional inquiry concerning records maintained and produced by the respondent, Hartford Public Schools, and also on having reached a settlement without full adjudication.
