     A regular meeting of the Freedom of Information Commission was held on May 27, 2015, in the Freedom of Information Hearing Room, 18-20 Trinity Street, Hartford, Connecticut. The meeting convened at 2:10 p.m. with the following Commissioners present:
     Commissioner Owen P. Eagan, presiding
     Commissioner Jay Shaw (participated via speakerphone)
     Commissioner Matthew Streeter
     Commissioner Christopher P. Hankins
     Commissioner Lenny T. Winkler
     Commissioner Ryan P. Barry
     Commissioner Francis J. Brady

     Also present were staff members, Colleen M. Murphy, Mary E. Schwind, Clifton A. Leonhardt, Kathleen K. Ross, Lisa F. Siegel, Tracie C. Brown, Valicia D. Harmon, Paula S. Pearlman, Virginia Brown, Cindy Cannata, and Thomas A. Hennick.
     The Commissioners unanimously voted, 6-0, to approve the minutes of the Commission’s regular meeting of May 27, 2015. Commissioner Brady abstained.
     Those in attendance were informed that the Commission does not ordinarily record the remarks made at its meetings, but will do so on request.

     The Commissioners unanimously voted to adopt the Hearing Officer’s Report.

     The Hearing Officer’s Report was withdrawn by the Hearing Officer.

     Catherine Mascetti appeared on behalf of the complainants. The Commissioners unanimously voted to adopt the Hearing Officer’s Report. The proceedings were recorded digitally.

Zachary Janowski and the Yankee Institute for Public Policy v. Legal Compliance Manager, Connecticut Health Insurance Exchange; and Connecticut Health Insurance Exchange
     Zachary Janowski appeared on behalf of the complainants. Attorney Kate Simone appeared on behalf of the respondents. The Commissioners unanimously voted to amend the Hearing Officer’s Report. The Commissioners unanimously voted to remand the matter to Hearing Officer for the purpose of collecting more evidence on the issue of pricing information and trade secrets. The matter was recorded digitally.

     The Commissioners unanimously voted to adopt the Hearing Officer’s Report.

     The Commissioners unanimously voted to adopt the Hearing Officer’s Report.
Alyssa Peterson v. Executive Director, State of Connecticut, Commission on Human Rights and Opportunities; Chairman, State of Connecticut, Commission on Human Rights and Opportunities; and State of Connecticut, Commission on Human Rights and Opportunities
     The Commissioners unanimously voted to adopt the Hearing Officer’s Report.

     The Commissioners unanimously voted to affirm the Decision Not to Schedule in Tyriece Fuller v. State's Attorney, State of Connecticut, Division of Criminal Justice, Office of the State's Attorney, Judicial District of Fairfield; and State of Connecticut, Division of Criminal Justice, Office of the State's Attorney, Judicial District of Fairfield, Docket # FIC 2014-941.

          Colleen M. Murphy and Paula S. Pearlman reported on legislation.
          The meeting was adjourned at 3:25 p.m.

AMENDMENTS

Zachary Janowski and the Yankee Institute for Public Policy v. Legal Compliance Manager, Connecticut Health Insurance Exchange; and Connecticut Health Insurance Exchange
     The Hearing Officer’s Report is amended as follows:
     14.  It is found that the Exchange created [a separate entity called] Access Health Exchange Solutions (“Solutions”).  It is found that Solutions owns the app, and intends to market and ultimately resell the app to other health exchanges.
     The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The respondents shall, forthwith, provide [an unredacted] A copy of the contract to the complainants, free of charge.
2. IN COMPLYING WITH PARAGRAPH 1 OF THE ORDER, ABOVE, THE RESPONDENTS MAY REDACT THE INFORMATION IDENTIFIED IN EXHIBIT B AS ITEM NUMBERS 1 THROUGH 6, AND 10.
