RE: Minutes of the Commission’s regular meeting of January 25, 2012
     A regular meeting of the Freedom of Information Commission was held on January 25, 2012, in the Freedom of Information Hearing Room, 18-20 Trinity Street, Hartford, Connecticut. The meeting convened at 2:12 p.m. with the following Commissioners present:

     Commissioner Norma E. Riess, presiding
     Commissioner Sherman D. London
     Commissioner Owen P. Eagan
     Commissioner Amy J. LiVolsi
     Commissioner Jay Shaw (participated via speakerphone)
      
     Also present were staff members, Colleen M. Murphy, Mary E. Schwind, Clifton A. Leonhardt, Victor R. Perpetua, Tracie C. Brown, Kathleen R. Ross, Lisa F. Siegel, Valicia D. Harmon, Paula S. Pearlman, Cindy Cannata and Thomas A. Hennick.

     Those in attendance were informed that the Commission does not ordinarily record the remarks made at its meetings, but will do so on request.
     The Commissioners unanimously voted to adopt the minutes of the Commission’s regular meeting of January 11, 2011.  
Jesus Diaz v. Chief, Police Department, City of Meriden; and Police Department, City of Meriden
     Jesus Diaz participated via speakerphone. The Commissioners unanimously voted to adopt the Hearing Officer’s Report.
Gary Sadler v. Warden, State of Connecticut, Department of Correction, MacDougall-Walker Correctional Institution; Director, Tactical Operations, State of Connecticut, Department of Correction, MacDougall-Walker Correctional Institution; Canine Unit Supervisor,State of Connecticut, Department of Correction, MacDougall-Walker Correctional Institution; and State of Connecticut, Department of Correction
     The Commissioners unanimously voted to adopt the Hearing Officer’s Report.
James Torlai v. Commissioner, State of Connecticut, Department of Public Safety; and State of Connecticut, Department of Public Safety
     The Commissioners unanimously voted to adopt the Hearing Officer’s Report.
Loren Casertano v. Chief, Police Department, City of Shelton; and Police Department, City of Shelton
     The Commissioners unanimously voted to adopt the Hearing Officer’s Report.

     The Commissioners unanimously voted to adopt the Hearing Officer’s Report.
The Connecticut Resources Recovery Authority v. Chief Executive Officer, The Metropolitan District Commission; and The Metropolitan District Commission
     The Commissioners postponed action on this matter.

     The Commissioners unanimously voted to correct the Hearing Officer’s Report. The Commissioners unanimously voted to adopt the Hearing Officer’s Report as corrected.*
James Duda v. Shawn Boyne, Chief, Police Department, Town of New Milford; Police Department, Town of New Milford; and Pat Murphy, Mayor, Town of New Milford
     The Commissioners unanimously voted to adopt the Hearing Officer’s Report.
Kevin Brookman v. Daryl Roberts, Chief, Police Department, City of Hartford; and Police Department, City of Hartford
     The Commissioners unanimously voted to adopt the Hearing Officer’s Report.

     The Commissioners unanimously voted to adopt the Hearing Officer’s Report.
     Victor R. Perpetua reported on pending appeals.
     Colleen M. Murphy reported that the annual Freedom of Information conference will take place April 3, 2012 at the Rocky Hill Marriott.
              
     The meeting was adjourned at 2:31 p.m.

CORRECTIONS
James Findlay v. Chairman, Housing Authority, Town of Mansfield; and Housing Authority, Town of Mansfield

     The Hearing Officer’s Report is corrected as follows:
     6. It is found that by letter dated March 28, 2011, the complainant clarified his request
stating that he was requesting an opportunity to review the records described in paragraph [2] 3a and b, above, himself.
     8. It is found that by letter dated April 6, 2011, the complainant indicated that his March
19, 2011 request was not limited to records related to him or his father but rather his request was to inspect any and all records responsive to the request described in paragraph [2] 3a and b,
above. 
     13. It is found that the records described in paragraph [2] 3a and b, above, are public
records within the meaning of §§1-200(5), 1-210(a), and 1-212(a), G.S.
     16. The chairman testified and it is found that there are no records responsive to the
complainant’s request described in paragraph [2] 3a and b, above, because, as stated above,
Rebecca Fields and Karen Matychak do not e-mail each other.
