Attendance At Hearings

The DSS Hearing Officer conducts the hearings.

For DSS program hearings, the Appellant must be at the hearing (or on the telephone), except if there is a physical or mental condition that prevents attendance. In addition, an attorney, authorized representative, legal representative, or anyone else the Appellant wishes to attend the hearing may be there and may speak for the Appellant.

A representative of the Department or of a contractor for the Department will also be at the hearing.

For nursing facility transfer or discharge hearings, and hearings relating to a facility’s failure to readmit a resident, in addition to the nursing facility resident and anyone the resident wishes to attend, a representative(s) of the facility will be at the hearing.
