TEAMS HEARING

 

 

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call.  Three appellants were present, one appellant failed to appear. Four local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Carolyn Futtner Esq., Dr. Cynthia Conrad, Anthony Iaconis, Esq., Gudrun Johnson, and Col. Chris Lewis.

Board Members Absent: Chief Carl Rosensweig and Stephen Sanetti, Esq.

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Twelve cases were heard in the following order:

1) Case No. 19-735-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Staff Attorney Kate Ayers represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his case.

2) Case No. 20-006-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Staff Attorney Kate Ayers represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his case.

3) Case No. 21-247-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Lt. Art Weisgerber represented the Local Issuing Authority, Chief Thomas Kulhawik, Norwalk Police Department.

Withdrawal: The appellant withdrew his case.

4) Case No. 21-216-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Sgt. William Bernabucci represented the Local Issuing Authority, Chief William Baldwin, Torrington Police Department.

Withdrawal: The appellant withdrew his case.

5) Case No. 20-005-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Staff Attorney Kate Ayers represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Motion: Board member Dr. Conrad made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Ms. Johnson, motion passed unanimously.

6) Case No. 21-194-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Chief Warren Hyatt represented the Local Issuing Authority, Chief Warren Hyatt, Town of Guilford.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit at this time.

7) Case No. 21-221-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear.  Lt. Brian Hubbs represented the Local Issuing Authority, Acting Chief Michael Timbro, Middletown Police Department.

Motion: Board member Ms. Johnson made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Dr. Conrad, motion passed unanimously.

8) Case No. 21-264-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear.  Ofc. Dennis Putnam represented the Local Issuing Authority, John Sullivan, Hamden Police Department.

Motion: Board member Ms. Johnson made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Atty. Iaconis, motion passed unanimously.

9) Case No. 19-677-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Staff Attorney Kate Ayers represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his case.

10) Case No. 21-275-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Ofc. Dennis Putnam represented the Local Issuing Authority, John Sullivan, Hamden Police Department.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered Hamden to issue the permit. 

11) Case No. 21-205-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Ofc. Massimo Piroli represented the Local Issuing Authority, Kevin Halloran, North Branford Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit.

12) Case No. 20-629-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by John Q. Gale, Esq. Lt. Stephen Elliott represented the Local Issuing Authority, John Daly, Southington Police Department with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit at this time.

 

Secretary’s Report:

Board Secretary Futtner made a motion to accept the minutes from September 2, 2021, seconded by Dr. Conrad, motion carried.
