BOARD OF FIREARMS PERMIT EXAMINERS

Thursday, September 10, 2020, 10am at the

Wethersfield Police Department, 250 Silas Deane Hwy.

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call.  Three appellants were present, one appellant failed to appear. Four local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf, Carolyn Futtner Esq., Anthony Iaconis, Esq., and Gudrun Johnson and Mr. M. Peter Kuck.

Board Members Absent: Dr. Cynthia Conrad, MD and Chief Carl Rosensweig

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Four cases were heard in the following order:

1) Case No. 19-636-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Chief Steven Clark represented the Local Issuing Authority, Chief Steven Clark, Newington Police Department.

Decision: By a majority decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit. Chairman Blando, Secretary Overturf, Atty. Futtner, Atty. Ioconis and Ms. Johnson voted in favor of the Local Issuing Authority. Mr. Kuck voted in favor of the Appellant.

2) Case No. 20-159-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf.  Sgt. Avery Marsh represented the Local Issuing Authority, Chief Patrick Daley, Norwich Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit.

3) Case No. 20-277-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear.  First Selectman, Patricia DelMonaco represented the Local Issuing Authority, First Selectman, Patricia DelMonaco, Town of New Fairfield with one witness.

Motion: Board Secretary Overturf made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Johnson, motion passed unanimously.

4) Case No. 20-241-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf.  Cpt. Andrew Power represented the Local Issuing Authority, Chief Donald Melanson, Windsor Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit at this time.

 

Secretary’s Report:

Board Secretary Overturf made a motion to accept the minutes from August 20, 2020, seconded by Ms. Johnson, motion carried. Mr. Kuck abstained.

 

New Business:

 

Shared email from the AG’s office that the Board’s request for an appeal has been denied on Case 17-723-D.

 

Adjournment: Board member Kuck made a motion to adjourn. Seconded by Board Secretary Overturf, motion carried. Meeting ended at 11:25am.
