BOARD OF FIREARMS PERMIT EXAMINERS

Thursday, November 5, 2020 10am at the

Wethersfield Police Department, 250 Silas Deane Hwy.

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call.  Four appellants were present, two appellants failed to appear. The State Issuing Authority and five local Issuing Authorities.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf, Carolyn Futtner Esq., Anthony Iaconis, Esq., and Gudrun Johnson.

Board Members Absent: Dr. Cynthia Conrad, Mr. M. Peter Kuck and Chief Carl Rosensweig

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Six cases were heard in the following order:

1) Case No. 19-733-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Joseph Legan represented the Local Issuing Authority, Chief Joseph McNeil, Stratford Police Department with one witness.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered Stratford to issue the permit.

2) Case No. 20-305-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Det. Joseph Legan represented the Local Issuing Authority, Chief Joseph McNeil, Stratford Police Department with one witness.

Continued: Due to the appellant calling in the morning, explaining she was not feeling well, the Board and Local Issuing Authority agreed to continue her case to March 4, 2021 when another Stratford case is scheduled to be heard.

3) Case No. 20-360-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Det. Joseph Legan represented the Local Issuing Authority, Chief Joseph McNeil, Stratford Police Department.

Motion: Board Secretary Overturf made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Johnson, motion passed unanimously.

4) Case No. 19-216-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Tpr. Douglas Sauve represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit.

 

 

5) Case No. 20-075-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Joseph Legan represented the Local Issuing Authority, Chief Joseph McNeil, Stratford Police Department with one witness.

Decision: By a majority decision, the Board voted to uphold the revocation of the State Issuing Authority the revocation of the permit. Chairman Blando, Esq., Secretary Overturf, Atty. Futtner Esq., and Atty.Iaconis voted in favor of the Local Issuing Authority at this time. Ms. Johnson voted in favor of the appellant.

6) Case No. 21-054-CD, involving the Constructive Denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Jeff Foran represented the Local Issuing Authority, Chief William Darby, Manchester Police Department.

Motion: Board member Johnson made a motion for the Local Issuing Authority, due to the appellant not submitting a full application. Motion was seconded by Atty. Futtner, motion passed unanimously 5-0.

Secretary’s Report:

Board Secretary Overturf made a motion to accept the minutes for October 22, 2020, seconded by Atty. Futtner, motion carried. Atty. Iaconis abstained.

 

New Business:

 

The Board voted to approve the 2021 Hearing Schedule consisting of 22 hearings.

 

The Board discussed testing a Team virtual hearing at the next hearing Thursday, November 19, 2020.

 

 

Adjournment: Board member Johnson made a motion to adjourn. Seconded by Board Secretary Overturf, motion carried. Meeting ended at 12:35pm.
