BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call.  Eleven appellants were present, one appellant failed to appear. The State Issuing Authority and eight Local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf, Carolyn Futtner Esq., Anthony Iaconis, Esq., Gudrun Johnson, Mr. M. Peter Kuck and Chief Carl Rosensweig.

Board Members Absent: Dr. Cynthia Conrad, MD

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Twelve cases were heard in the following order:

1) Case No. 18-533-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Det. Michael Evangelisti represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his case. State will reissue.

2) Case No. 20-025-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Ofc. Zmayefski represented the Local Issuing Authority, Town Manager, Mary Calorio, Town of Killingly.

Withdrawal: The appellant withdrew his case.

3) Case No. 20-102-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf.   First Selectman represented the Local Issuing Authority, First Selectman Christopher Lippke, Town of Canterbury.

Decision: By majority decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit. Board Chairman Blando, Attorney Futtner, Ms. Johnson, and Chief Rosensweig voted in favor of the Issuing Authority. Board Secretary Overturf, Attorney Iaconis, and Mr. Kuck voted in favor of the Appellant.

4) Case No. 18-626-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq. with two witnesses.  Sgt. Alex Giannone represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit.  Board member Kuck recused himself from the vote.

5) Case No. 20-069-D involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Robert Brown was present for the local Issuing Authority, Chief Gerald  Narowski, Derby Police Department.

Motion: Board Secretary Overturf made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Ms. Johnson, motion passed unanimously.

6) Case No. 18-558-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.

Withdrawal: The appellant withdrew his case.

7) Case No. 18-644-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Det. Michael Evangelisti represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit at this time.

8) Case No. 20-067-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Tpr. Matthew Rei appeared for the Local Issuing Authority, First Selectman Todd Babbitt, Town of Griswold.

Decision: By majority decision, the Board voted in favor of the appellant. Board Chairman Blando, Board Secretary Overturf, Attorney Iaconis, Ms. Johnson and Mr. Kuck voted in favor of the appellant. Attorney Futtner and Chief Rosensweig voted in favor of the Local Issuing Authority.

9) Case No. 20-125-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Ofc. Louis Rivera was present for the local Issuing Authority, Chief Otoniel Reyes, New Haven Police Department.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered New Haven to issue the permit.

10) Case No. 19-694-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq. with one witness. Cpt. Chris Vanghele appeared for the local Issuing Authority, Chief James Viadero, Newtown Police Department.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered Newtown to issue the permit.

11) Case No. 20-053-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Greg Wityak appeared for the Local Issuing Authority, Chief William Baldwin, Torrington Police Department.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered Torrington to issue the permit.

12) Case No. 20-059-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Sgt. Greg Wityak appeared for the Local Issuing Authority, Chief William Baldwin, Torrington Police Department.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered Torrington to issue the permit.

 

 

Secretary’s Report:

Board Secretary Overturf made a motion to accept the minutes from December 12, 2019, seconded by Atty. Futtner, motion carried. Atty. Iaconis and Ms. Johnson abstained.
