BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:06am.

Chairman Blando read the Introductory Statement and called the roll call.  Thirteen appellants were present, one appellant failed to appear. The State Issuing Authority and eleven Local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Dr. Cynthia Conrad, Carolyn Futtner Esq., Mr. Peter Kuck and Chief Carl Rosensweig.

Board Members Absent: Secretary Col. Kyle Overturf, Atty. Iaconis and Gudrun Johnson.

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Fourteen cases were heard in the following order:

1) Case No. 20-114-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Joseph Legen represented the Local Issuing Authority, Chief Joseph McNeil, Stratford Police Department.

Withdrawal: The appellant withdrew his case, moved.

2) Case No. 20-104-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Chief Alaric Fox represented the Local Issuing Authority, Chief Alaric Fox, Enfield Police Department with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit.

3) Case No. 20-111-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Richard Franchi, Esq.  Ofc. Louis Rivera represented the Local Issuing Authority, Chief Otoniel Reyes, New Haven Police Department.

Withdrawal: The appellant withdrew his case, New Haven will issue.

4) Case No. 20-072-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.   Ofc. Louis Rivera represented the Local Issuing Authority, Chief Otoniel Reyes, New Haven Police Department.

Withdrawal: The appellant withdrew his case, New Haven will issue.

5) Case No. 20-100-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.   Ofc. Louis Rivera represented the Local Issuing Authority, Chief Otoniel Reyes, New Haven Police Department.

Withdrawal: The appellant withdrew his case, New Haven will issue.

6) Case No. 20-289-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Motion: Chief Rosensweig made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Atty. Futtner, motion passed unanimously.

7) Case No. 19-651-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq. Jason Buchsbaum, Esq. appeared for the Local Issuing Authority, First Selectman, Patricia DelMonaco, Town of New Fairfield with two witnesses.

Decision: By majority decision, the Board voted in favor of the appellant. Board Chairman Blando, Dr. Conrad, and Board member Kuck voted in favor of the appellant. Attorney Futtner and Chief Rosensweig voted in favor of the Local Issuing Authority. Vote was 3-2 in favor of the appellant.

8) Case No. 19-034-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Det. Michael Evangelisti represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with two witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit.

9) Case No. 19-052-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit.

10) Case No. 20-057-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq. with two witnesses.  Cpt. Brandon Marschner appeared for the Local Issuing Authority, Chief Keith Mello, Milford Police Department with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit at this time.

11) Case No. 19-631-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Lionel Rodriguez was present for the Local Issuing Authority, Chief Paul Hammick, Bloomfield Police Department.

Withdrawal: The appellant withdrew his case.

12) Case No. 20-136-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Joseph Legen was present for the Local Issuing Authority, Chief Joseph McNeil, Stratford Police Department.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered Stratford to issue the permit.

13) Case No. 20-112-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Avery Marsh was present for the Local Issuing Authority, Chief Patrick Daley, Norwich Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit.

14) Case No. 20-161-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Ofc. Louis Rivera was present for the Local Issuing Authority, Chief Otoniel Reyes, New Haven Police Department.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered New Haven to issue the permit.

 

Secretary’s Report:

Board member Atty. Futtner made a motion to accept the minutes from January 9, 2020, seconded by Mr. Kuck, motion carried. Dr. Conrad abstained.
