BOARD OF FIREARMS PERMIT EXAMINERS

Thursday, December 10, 2020 10am at the

Wethersfield Police Department, 250 Silas Deane Hwy.

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call.  Five appellants were present, one appellant failed to appear. The State Issuing Authority and three Local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf, Carolyn Futtner Esq., Gudrun Johnson and Mr. M. Peter Kuck.

Board Members Absent: Dr. Cynthia Conrad, Anthony Iaconis, Esq. and Chief Carl Rosensweig

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Six cases were heard in the following order:

1) Case No. 20-297-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq. Captain Garon DelMonte represented the Local Issuing Authority, Chief Keith Mello, Milford Police Department with 2 witnesses.

Decision: By a majority vote, the Board voted in favor of the appellant. Chairman Blando, Board Secretary Overturf, Atty. Futtner and Board member Kuck voted in favor of the appellant.  Board member Johnson vote in favor of the Local Issuing Authority. The Board ordered Milford to issue the permit. Vote was 4-1 in favor of the appellant.

2) Case No. 20-577-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Dep. Counsel Skelly represented the Local Issuing Authority, Chief Christopher Chute, New Britain Police Department with one witness.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered New Britain to issue the permit.

3) Case No. 19-335-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

 

Motion: Board Secretary Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.

4) Case No. 20-423-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.   Det. Rodriguez was represented the Local Issuing Authority, Chief Paul Hammick, Bloomfield Police Department.

Withdrawal: The appellant withdrew his case.

5) Case No. 20-189-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq.. Dep. Counsel Skelly represented the Local Issuing Authority, Chief Christopher Chute, New Britain Police Department with one witness.

Decision: By a majority vote, the Board voted in favor of the Local Issuing Authority. Chairman Blando, Board Secretary Overturf, Board member Johnson and Board member Kuck voted in favor of the Local Issuing Authority at this time.  Atty. Futtner vote in favor of the appellant. Vote 4-1 in favor of the Issuing Authority.

6) Case No. 20-417-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.   Det. Rodriguez was represented the Local Issuing Authority, Chief Paul Hammick, Bloomfield Police Department.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered Bloomfield to issue the permit.

 

Secretary’s Report:

Board Secretary Overturf made a motion to accept the minutes from November 5, 2020 seconded by Ms. Johnson, motion carried. Board member Kuck abstained.

 

New Business:

 

Discussion for virtual hearings. Board has agreed to start Teams virtual hearings starting

January 7, 2021.

 

 

Adjournment: Board Secretary Overturf made a motion to adjourn. Seconded by Board member Johnson, motion carried. Meeting ended at 12:50pm.
