BOARD OF FIREARMS PERMIT EXAMINERS

Thursday, August 20, 2020, 10am at the

Wethersfield Police Department, 250 Silas Deane Hwy.

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call.  Six appellants were present, one appellant failed to appear. The State Issuing Authority and two Local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf,

Carolyn Futtner Esq., Anthony Iaconis, Esq., and Gudrun Johnson.

 

Board Members Absent: Dr. Cynthia Conrad, MD, Mr. M. Peter Kuck and Chief Carl Rosensweig.

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Seven cases were heard in the following order:

1) Case No. 19-365-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone, Esq. represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his case.

2) Case No. 19-077-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone, Esq. represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit.

3) Case No. 20-308-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.   Dep. Chief Kristian Lindstrom represented the Local Issuing Authority, Chief Scott Custer, South Windsor Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit.

4) Case No. 20-349-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.   Dep. Chief Kristian Lindstrom represented the Local Issuing Authority, Chief Scott Custer, South Windsor Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit at this time.

 

 

5) Case No. 19-214-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Alex Giannone, Esq. represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Motion: Board Secretary Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Ms. Johnson, motion passed unanimously.

6) Case No. 19-197-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Michael Evangelisti represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit at this time.

7) Case No. 19-195-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone, Esq. represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Decision: By majority vote the Board voted in favor of the Appellant. The vote was 3-2. Chairman Blando, Board Secretary Overturf and Atty Futtner voted in favor of the Appellant. Atty Iaconis and Ms. Johnson voted in favor of the State Issuing Authority.

Secretary’s Report:

Board Secretary Overturf made a motion to accept the minutes from July 23, 2020, seconded by Ms. Johnson, motion carried. Atty. Iaconis abstained from the vote.

 

New Business:

 

Waiting on an approval from Solicitor General about the Boards new appeal after the Superior Court overturned Board decision.

 

Talk of notifying the appellant and Issuing Authority that only those who are going to testify should be allowed into the room to keep in compliance with the CDC. 

 

Adjournment: Board Secretary Overturf made a motion to adjourn. Seconded by Board member Johnson, motion carried. Meeting ended at 1:15pm.
