Call to Order

Acting Chairman Carolyn Futtner called the meeting to order at 10:00am.

Acting Chairman Futtner read the Introductory Statement and called the roll call.  Fourteen appellants were present, one appellant failed to appear. The State Issuing Authority and eight local Issuing Authorities were present and one failed to appear (permit was already issued).

Board Members Present: Acting Chairman Carolyn Futtner Esq., Secretary Col. Kyle Overturf., Dr. Cynthia Conrad, Anthony Iaconis, Esq., Mr. Peter Kuck, and Chief Carl Rosensweig.

Board Members Absent: Chairman Frank P. Blando and Gudrun Johnson.

Acting Chairman Carolyn Futtner administered the oath to all witnesses.

Hearings: Fifteen cases were heard in the following order:

1) Case No. 18-443-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his case and the state will reissue.

2) Case No. 18-392-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Withdraw: The appellant withdrew his case

3) Case No. 19-482-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.   Chief James Kenny represented the Local Issuing Authority, Chief James Kenny, Vernon Police Department with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit.

4) Case No. 19-484-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.   Chief Jeffrey Kreitz represented the Local Issuing Authority, Chief Jeffrey Kreitz, Ridgefield Police Department with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit.

5) Case No. 19-456-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. No one was present for the local Issuing Authority, Chief William Baldwin, Torrington Police Department.

Withdraw: The appellant withdrew his case, Torrington already issued the permit. 

6) Case No. 18-138-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Motion: Board Secretary Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.

7) Case No. 18-473-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Withdraw: The appellant withdrew his case.

8) Case No. 18-456-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with two witnesses.

Decision: By majority decision the Board voted in favor of the State Issuing Authority. Board member Kuck voted in favor of the appellant. Acting Chairman Futtner, Board Secretary Col. Overturf, Dr. Conrad, Atty. Iaconis, Esq. Chief Rosensweig voted in favor of the State Issuing Authority. Vote was 5-1 in favor of the State Issuing Authority at this time. 

9) Case No. 19-208-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq.  Sgt. Kenneth Keroack was present for the local Issuing Authority, Chief Fernando Spagnolo, Waterbury Police Department.

Withdraw: The appellant withdrew his case.

10) Case No. 18-300-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Withdraw: The appellant withdrew his case.

11) Case No. 19-523-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf.  Lt. Joseph LaRose appeared for the local Issuing Authority, Chief Patrick Ridenhour, Danbury Police Department.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered Danbury to issue the permit.

12) Case No. 19-359-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Det. Joseph Legen appeared for the local Issuing Authority, Chief Joseph McNeil, Stratford Police Department.

Decision: By majority decision the Board voted in favor of the appellant. Board member Chief Rosensweig voted in favor of the Local Issuing Authority. Acting Chairman Futtner, Board Secretary Col. Overturf, Board members Dr. Conrad, Atty. Iaconis, Esq. and Mr. Kuck voted in favor of the appellant. Vote was 5-1 in favor of the appellant. 

13) Case No. 19-558-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf.  Det. Chris Collins appeared for the local Issuing Authority, Chief Paul Hammick, Bloomfield Police Department.

Motion: Board Secretary Overturf made a motion for the appellant, seconded by Mr. Kuck. Motion carried unanimously.

14) Case No. 19-409-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq.  Asst. Chief Max Martins appeared for the local Issuing Authority, Chief Robert Gagne, Orange Police Department.

Decision: By majority decision the Board voted in favor of the appellant. Board Secretary Col. Overturf voted in favor of the Local Issuing Authority. Acting Chairman Futtner, Board members Dr. Conrad, Atty. Iaconis, Esq. and Chief Rosensweig voted in favor of the appellant. Mr. Kuck abstained from the vote. Vote was 4-1-1 in favor of the appellant. 

15) Case No. 18-548-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq.  Ofc. Earl Baidy appeared for the Local Issuing Authority, Chief Eric Osanitsch, Windsor Locks Police Department.

Decision: By majority decision the Board voted in favor of the appellant. Board Secretary Col. Overturf, Board member Atty. Iaconis, and Chief Rosensweig voted in favor of the Local Issuing Authority. Acting Chairman Futtner, Board members Dr. Conrad, and Mr. Kuck voted in favor of the appellant. Vote was 3-3.  Tie vote goes in favor of the appellant. 

Secretary’s Report:

The minutes have been tabled until the October 3, 2019 hearing due to the lateness of receiving the document.
