BOARD OF FIREARMS PERMIT EXAMINERS

Thursday, June 6, 2019, 10am at the

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando did the swearing in of new Board member, Anthony Iaconis, representing Connecticut State Rifles and Revolvers Association.

Chairman Blando read the Introductory Statement and called the roll call.  Five appellants were present, three appellants failed to appear. The State Issuing Authority and four Local Issuing Authorities were present and one failed to appear.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf, Carolyn Futtner Esq., Anthony Iaconis, Esq., Mr. M. Peter Kuck, Chief Carl Rosensweig and Dr. William Sledge

Board Members Absent: Gudrun Johnson

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Eight cases were heard in the following order:

1) Case No. 18-277-SD, involving the state denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Michael Evangelisti represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his case.

2) Case No. 18-197-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Michael Evangelisti represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered the State Issuing Authority to reinstate the permit.

3) Case No. 19-231-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.   Sgt. Mark Juhola represented the Local Issuing Authority, Town of Montville Police Services.

Withdrawal: The appellant withdrew his case.

4) Case No. 19-183-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Chief Michael Surprenant was present for the Local Issuing Authority, Chief Michael Surprenant, Plainfield Police Department.

Motion: Secretary Col. Overturf made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Futtner, motion passed unanimously.

5) Case No. 19-248-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Kenneth Keroack was present for the Local Issuing Authority, Chief Fernando Spagnolo, Waterbury Police Department.

Motion: Board member Dr. Sledge made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Mr. Kuck, motion passed unanimously.

6) Case No. 19-117-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear.   Asst. Corp. Counsel Joseph Skelly represented the Local Issuing Authority, Chief Christopher Chute, New Britain Police Department.

Motion: Secretary Col. Overturf made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.

7) Case No. 19-141-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. No one was present for the Local Issuing Authority, Chief William T. Fitzgerald, Winchester Police Department.

Motion: Secretary Col. Overturf made a motion for the appellant, by default, due to the Local Issuing Authority failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.

8) Case No. 18-324-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf with one witness. Det. Michael Evangelisti represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit.

Secretary’s Report:

Board Secretary Overturf made a motion to accept the minutes from May 16, 2019, seconded by Dr. Sledge, motion carried.  Board member Iaconis abstained.

Adjournment: Board member Kuck made a motion to adjourn, seconded by Board Secretary Overturf, motion carried. Meeting ended at 11:27am.
