BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call.  Eleven appellants were present, one appellant failed to appear. The State Issuing Authority and eight local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf, Dr. William Sledge, Carolyn Futtner Esq., Chief Carl Rosensweig, Gudrun Johnson and Mr. M. Peter Kuck.

Board Members Absent: None

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Twelve cases were heard in the following order:

1) Case No. 17-710-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Tpr. Doug Sauve represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Withdrew: The appellant withdrew his case with the understanding that the state will reissue.

2) Case No. 18-200-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Kenneth Barber, Esq. with two witnesses.  Det. Sgt. Andrew Dzierzgowski was present for the local Issuing Authority, Chief Eric Osanitsch, Windsor Locks Police Department.

Decision: By majority decision, the Board voted to uphold the decision of the local Issuing Authority, the denial of the pistol permit. Mr. Kuck voted in favor of the appellant.  Chairman Blando, Col. Overturf, Dr. Sledge, Chief Rosensweig, Atty. Futtner, and Ms. Johnson voted in favor of the Issuing Authority.

3) Case No. 17-697-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Trp. Doug Sauve represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Motion: Chief Rosensweig made a motion for the State Issuing Authority seconded by Ms. Johnson.  After a discussion, Ms. Johnson withdrew her second and Chief Rosensweig withdrew his motion.

Withdrew: The appellant withdrew his case.

4) Case No. 18-282-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq.  Attorney Jason Buchsbaum represented the local Issuing Authority, First Selectman, Patricia DelMonaco, Town of New Fairfield who was the one witness.

Continuance: This case has been continued to April 11, 2019.

5) Case No. 18-169-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Attorney Jason Buchsbaum represented the local Issuing Authority, First Selectman, Patricia DelMonaco, Town of New Fairfield who was the one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, the denial of the pistol permit.

6) Case No. 18-355-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Attorney Jason Buchsbaum represented the local Issuing Authority, First Selectman, Patricia DelMonaco, Town of New Fairfield who was the one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, the denial of the pistol permit.

7) Case No. 18-180-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Det. Angelo Stavrides was present for the local Issuing Authority, Chief Jeffry Cossette, Meriden Police Department.

Withdrew: The appellant withdrew his case with the understanding that Meriden will issue.

8) Case No. 18-198-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Officer Jacques appeared for the local Issuing Authority, Chief Anthony Campbell, New Haven Police Department.

Motion: Board Member Kuck made a motion in favor of the appellant. Dr. Sledge seconded the motion, motion passed unanimously.

9) Case No. 18-023-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Trp. Doug Sauve represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Motion: Board Member Kuck made a motion in favor of the State Issuing Authority due to the appellant’s failure to appear. Dr. Sledge seconded the motion, motion passed unanimously.

10) Case No. 18-673-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf with one witness.   Trp. Doug Sauve represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, the denial of the pistol permit at this time.

11) Case No. 18-492-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Asst. Counsel Joseph Skelly appeared for the local Issuing Authority, Acting Chief Christopher Chute, New Britain Police Department with one witness.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered New Britain to issue the permit.

12) Case No. 18-009-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Officer Caserta represented the local Issuing Authority, Chief Jonathan Fontneau, Stamford Police Department.

Withdrew: The appellant withdrew his case.

Secretary’s Report:

Board member Johnson made a motion to accept the minutes from January 24, 2019, seconded by Mr. Kuck, motion carried. Col. Overturf and Dr. Sledge abstained from the vote.

Adjournment: Board member Kuck made a motion to adjourn. Seconded by Dr. Sledge motion carried unanimously.  Meeting ended at 2:55pm.
