BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Acting Chairman Carolyn M. Futtner, Esq. called the meeting to order at 10:00am.

Acting Chairman Carolyn M. Futtner read the Introductory Statement and called the roll call.  Ten appellants were present, Three appellant failed to appear and one case was resolved the day before the hearing. The State Issuing Authority and nine local Issuing Authorities were present and one failed to appear.

Board Members Present: Acting Chairman Carolyn Futtner Esq., Secretary Col. Kyle Overturf, Dr. William Sledge, Chief Rosensweig and Mr. M. Peter Kuck.

Board Members Absent: Chairman Frank Blando and Gudrun Johnson

Acting Chairman Carolyn Futtner administered the oath to all witnesses.

Hearings: Thirteen cases were heard in the following order:

1) Case No. 17-272-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Michael Panton represented the local Issuing Authority, Chief Joseph McNeil, Stratford Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, the denial of the pistol permit.

2) Case No. 17-375-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq. Atty. Thomas Witherington represented the local Issuing Authority, First Selectman Wade Cole, Town of Hartland with two witnesses.

Motion: Secretary Col. Kyle Overturf made a motion in favor of the appellant. Board Member Kuck seconded the motion, motion passed unanimously.

3) Case No. 17-561-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Secretary Col. Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.

4) Case No. 17-557-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Secretary Col. Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.

5) Case No. 17-305-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit.

6) Case No. 17-087-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. No one was present for the local Issuing Authority, Chief William Fitzgerald, Winchester Police Department.

Decision: This case has been marked off.

7) Case No. 17-095-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Heather Desmond was present for the local Issuing Authority, Chief William McKenna, Middletown Police Department with two witnesses.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, the denial of the pistol permit.

8) Case No. 17-218-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Det. Michael Panton represented the local Issuing Authority, Chief Joseph McNeil, Stratford Police Department.

Motion: Secretary Col. Kyle Overturf made a motion in favor of the appellant. Board Member Kuck seconded the motion, motion passed unanimously.

9) Case No. 18-082-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Atty. Rachel M. Baird.. Det. Michael Panton appeared for the local Issuing Authority, Chief Joseph McNeil, Stratford Police Department with one witness.

Decision: By a majority vote, the Board voted to uphold the decision of the local Issuing Authority, the denial of the pistol permit. Acting Chairman Atty. Carolyn M. Futtner, Col. Overturf, Dr. Sledge and Chief Rosensweig voted in favor of the Issuing Authority and Mr. Kuck voted in favor of the appellant.

10) Case No. 17-731-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Lt. Paul Hussey appeared for the local Issuing Authority, Chief Roberto Rosado, Willimantic Police Department.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered Willimantic to issue the permit.

11) Case No. 17-750-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Off. Shane Wityak appeared for the local Issuing Authority, Chief Anthony Campbell, New Haven Police Department.

Withdrawl: The appellant withdrew his case with the understanding that New Haven will issue he permit.

12) Case No. 17-762-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Off. Peter Lovermi. appeared for the local Issuing Authority, Chief Kevin Hale, Ansonia Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, the denial of the pistol permit.

13) Case No. 17-732-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Atty. Ralph D. Sherman. Det. Sgt. Adam Marcus represented the local Issuing Authority, Chief Patrick Ridenhour, Danbury Police Department.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered Danbury to issue the permit.

Secretary’s Report:

Board Secretary Col. Overturf made a motion to accept the minutes from August 23, 2018, seconded by Board member Chief Rosensweig, motion carried.
