BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call.  Twelve appellants were present, one appellant failed to appear. The State Issuing Authority and seven local Issuing Authorities were present. Three Issuing Authorities failed to appear.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf, Mr. M. Peter Kuck, Carolyn Futtner Esq., Dr. William Sledge, Chief Carl Rosensweig and Gudrun Johnson

Board Members Absent: None

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Thirteen cases were heard in the following order:

1) Case No. 18-105-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Slavrides represented the local Issuing Authority, Chief Jeffry Cossette, Meriden Police Department.

Motion: Chief Carl Rosensweig made a motion for the Local Issuing Authority, the motion was seconded by Ms. Johnson, motion passed unanimously.

2) Case No. 18-144-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  No one represented the local Issuing Authority, Chief Chris Arciero, Canton Police Department.

Motion: Board Member Kuck made a motion for the appellant by default, due to the Local Issuing Authority, failing to appear. Motion was seconded by Col. Kyle Overturf, motion passed unanimously.

3) Case No. 17-468-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Charles K. Thompson Esq.. Ofc. Brian Phillips represented the local Issuing Authority, Chief Anthony Campbell, New Haven Police Department.

Withdrew: Appellant withdrew his case

4) Case No. 17-545-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Michael Panton represented the local Issuing Authority, Chief Joseph McNeil, Stratford Police Department.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered Stratford to issue the permit.

5) Case No. 18-127-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Lt. LaRose represented the local Issuing Authority, Chief Patrick Ridenhour, Danbury Police Department.

Motion: Secretary Col. Overturf made a motion for the Local Issuing Authority, due to the appellant no longer living in the town of Danbury. Motion was seconded by Board Member Kuck, motion passed unanimously.

6) Case No. 18-086-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Vincent L. Noce, Esq. No one was present for the local Issuing Authority,, Chief James Viadero, Newtown Police Department.

Motion: Secretary Col. Overturf made a motion for the appellant by default, due to the Local Issuing Authority, failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.

7) Case No. 18-122-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. No one was present for the local Issuing Authority, First Selectman Patricia DelMonaco, Town of New Fairfield.

Motion: Secretary Col. Overturf made a motion for the appellant by default, due to the Local Issuing Authority, failing to appear. Motion was seconded by Board Member Johnson, motion passed unanimously.

8) Case No. 18-053-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Christian Young, Esq, Det. Michael Panton appeared for the local Issuing Authority, Chief Joseph McNeil, Stratford Police Department.

Decision: By a majority decision, the Board voted in favor of the appellant and ordered Stratford to issue the permit. Chief Rosensweig voted in favor of the Local Issuing Authority, Chairman Blando, Col. Overturf, Attorney Futtner, Ms. Johnson, Dr. Sledge and Mr. Kuck voted in favor of the appellant. 

9) Case No. 18-156-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Schmalberger appeared for the local Issuing Authority, Chief Mark Rinaldi, Avon Police Department.

Decision: This case has been marked off.

10) Case No. 17-718-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Trp. Doug Sauve represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Secretary Col. Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.

11) Case No. 17-730-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Trp. Doug Sauve represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a majority decision, the Board voted to uphold the State Issuing.  Dr. Sledge voted in favor of the appellant. Chairman Blando, Col. Overturf, Attorney Futtner, Ms. Johnson, Chief Rosensweig and Mr. Kuck

12) Case No. 17-713-R.involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Trp. Doug Sauve represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit. Board Member Kuck recused himself from this case.

13) Case No. 17-562-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq. Lt. Jeffrey DePerry represented the local Issuing Authority, Chief Michael Spera, Old Saybrook Police Department.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered Stratford to issue the permit.

Secretary’s Report:

Board member Johnson made a motion to approve the minutes of October 18, 2018 seconded by Dr. Sledge, motion carried.  Mr. Kuck abstained from the vote.

Adjournment: Board member Kuck made a motion to adjourn, seconded by Col. Overturf, motion carried unanimously. Meeting ended at 2:45pm.
