BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call.  Ten appellants were present, four appellants failed to appear. The State Issuing Authority and ten local Issuing Authorities were present one local failed to appear..

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf, Dr. William Sledge, Carolyn Futtner, Esq., Ms. Gudrun Johnson, Mr. M. Peter Kuck, and Chief Carl Rosensweig.

Board Members Absent: None

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: 14 cases were heard in the following order:

1) Case No. 17-556-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Kim Nikola represented the local Issuing Authority, Chief Armando Perez, Bridgeport Police Department.

Withdrawal: The appellant withdrew his appeal.

2) Case No. 17-412-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Kim Nikola represented the local Issuing Authority, Chief Armando Perez, Bridgeport Police Department.

Withdrawal: The appellant withdrew his appeal.

3) Case No. 17-310-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.. Sgt. Martin Martinez represented the local Issuing Authority, First Selectman, Stanley Soby, Town of Colchester.

Withdrawal: The appellant withdrew his appeal.

4) Case No. 17-314-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant had already received his permit prior to the hearing. Detective Doug Sauve represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Decision: Case is marked off.

5) Case No. 17-243-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Detective Doug Sauve represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness

Decision: By majority decision, the Board voted to uphold the decision of the state Issuing Authority. Board Member Kuck voted in favor of the appellant, Chairman Blando, Secretary Overturf, Chief Rosensweig, Dr. Sledge, Board member Johnson and Atty. Futtner vote against the appellant.

6) Case No. 17-543-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Kim Nikola represented the local Issuing Authority, Chief Armando Perez, Bridgeport Police Department.

Motion: Secretary Col. Kyle Overturf made a motion to find for the local Issuing Authority due to the Appellant’s failure to appear, seconded by Board Member Johnson. Motion carried unanimously.

7) Case No. 17-610-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Kim Nikola represented the local Issuing Authority, Chief Armando Perez, Bridgeport Police Department.

Motion: Secretary Col. Kyle Overturf made a motion to find for the local Issuing Authority due to the Appellant’s failure to appear, seconded by Board Member Johnson. Motion carried unanimously.

8) Case No. 17-570-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. Neither the appellant or a representative for the Issuing Authority, Chief Jeffry Cossette appeared for this hearing.

Decision:  Case was marked off.  Past 90 day appeal time. No resolution on this case.

9) Case No. 18-014-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Attorney Ralph D. Sherman.  No one represented the local Issuing Authority, First Selectman, Derrylyn Gorski, Town of Bethany

Motion: Secretary Col. Kyle Overturf made a motion to find for the Appellant due to the local Issuing Authority, First Selectman, Derrylyn Gorski failure to appear, seconded by Board Member Kuck. Motion carried unanimously.

10) Case No. 17-350-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Detective Doug Sauve represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion:  Secretary Col. Kyle Overturf made a motion to find for the State Issuing Authority due to the Appellant’s failure to appear, seconded by Board Member Kuck. Motion carried unanimously.

11) Case No. 17-496-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Attorney Kevin Chamberlin.  Lt.. Keith Golding represented the local Issuing Authority, Chief Michael Lombardo, Trumbull Police Department.

Withdrawal: The appellant withdrew his appeal, Trumbull will issue.

12) Case No. 18-228-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Off. Omar Thomas represented the local Issuing Authority, Chief Anthony Campbell, New Haven Police Department.

Motion: Motion made by Chief Rosensweig for the appellant due to lack of evidence, seconded by Board member Johnson. Motion carried unanimously. 

13) Case No. 17-445-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Police Support Specialist Robert Strohl represented the local Issuing Authority, Chief Louis Fusaro, Jr., Town of Groton Police Department.

Motion: Motion made by Chief Rosensweig for the appellant due to end of pending case, seconded by Board member Johnson. Motion carried by majority.  Dr. Sledge voted against the appellant.  Chairman Blando, Col. Overturf, Chief Rosensweig, Atty. Futtner, Ms. Johnson, and Mr. Kuck voted in favor for the appellant.

14) Case No. 17-492-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Jeff Gilbert represented the local Issuing Authority, Chief Mark Rinaldo, Avon Police Department.

Motion: Motion made by Board member Kuck for the appellant due to lack of evidence, seconded by Board member Sledge. Motion carried unanimously.

Secretary’s Report:

Board member Col. Overturf made a motion to accept the April 26, 2018 minutes as submitted, Ms. Johnson seconded the motion, motion carried.

Adjournment: Board member Kuck made a motion to adjourn,  Dr. Sledge seconded the motion, motion carried. Meeting ended at 12:25pm.
