BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call.  Eleven appellants were present, two appellant failed to appear and four cases were resolved the day of and before the hearing. The State Issuing Authority and ten local Issuing Authorities were present and two failed to appear. Three cases were marked off.

Board Members Present: Chairman Frank P. Blando, Esq., Dr. William Sledge, Ms. Gudrun Johnson, Mr. M. Peter Kuck and Chief Carl Rosensweig.

Board Members Absent: Col. Kyle Overturf and Attorney Carolyn Futtner.

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Sixteen cases were heard in the following order 1 case withdrew prior to hearing:

1) Case No. 17-397-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Board Member Chief Rosensweig made a motion to find for the State Issuing Authority due to the appellant failing to appear, Board Member Kuck seconded the motion, motion carried unanimously.

2) Case No. 17-630-D, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Ofc. Phillips represented the Local Issuing Authority, Chief Anthony Campbell, New Haven Police Department.

Withdrawal: The appellant withdrew his appeal, New Haven will issue.

3) Case No. 17-569-D, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Ofc. Phillips represented the Local Issuing Authority, Chief Anthony Campbell, New Haven Police Department.

Withdrawal: The appellant withdrew his appeal, New Haven will issue.

Case No. 17-397-R, appellant arrived late and was told the Board already ruled on his case as he had an automatic disqualifier. 

4) Case No. 17-174-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant did not appear as the state had made an agreement with him. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Agreement: Case was marked off. SLFU made agreement and will reissue.

5) Case No. 17-517-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Monahan represented the local Issuing Authority, Acting Chief Fernando Spagnolo, Waterbury Police Department.

Motion: Chief Carl Rosensweig made a motion in favor of the Issuing Authority due to an automatic disqualifier seconded by Ms. Johnson. Motion carried unanimously.

6) Case No. 17-459-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Kim Nikola appeared for the local Issuing Authority, Chief Armando Perez, Bridgeport Police Department.

Motion: Board Member Kuck made a motion to find for the Local Issuing Authority due to the appellant failing to appear, Dr. Slege seconded the motion, motion carried unanimously.

7) Case No. 18-082-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Det. Michael Panton represented the local Issuing Authority, Chief Joseph McNeil, Stratford Police Department.

Continued: Continued to September 6, 2018.

8) Case No. 17-524-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Martin Martinez represented the local Issuing Authority, First Selectmen, Art. Shilosky, Town of Colchester.

Decision: By a unanimous decision, the Board voted to uphold the decision for the Local Issuing Authority the denial of the appellants pistol permit.

9) Case No. 16-086-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant did not appear as the state had offered to reinstate his permit. Sgt. Alex Giannone who represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection had also left.

Agreement: The case has been marked off.

10) Case No. 16-372-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant did not appear as the state had offered to reinstate his permit. Sgt. Alex Giannone who represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection had also left.

Agreement: The case has been marked off.

11) Case No. 16-349-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear.  Lt. Jay Susky represented the local Issuing Authority, Chief John Daly, Southington Police Department.

Motion: Board Member Chief Rosensweig made a motion to find for the Local Issuing Authority due to the appellant failing to appear, Board Member Kuck seconded the motion, motion carried unanimously.

12) Case No. 17-674-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Attorney Robert Lacobelle.   The local Issuing Authority failed to appear, First Selectmen, George Temple, Town of Oxford.

Motion: Board Member Kuck made a motion to find for the the appellant due to the Local Issuing Authority failure to appear, seconded by Dr. Sledge. Motion carried unanimously.

13) Case No. 17-674-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Attorney Kerry M. Gleason.   The local Issuing Authority failed to appear, Chief Keith Mello, Milford Police Department.

Motion: Board Member Kuck made a motion to find for the the appellant due to the Local Issuing Authority failure to appear, seconded by Dr. Sledge. Motion carried unanimously.

14) Case No. 17-600-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  First Selectman Michael Alberts represented the local Issuing Authority, Town of Woodstock.

Continued: Continued to next available hearing date.

Update:  Woodstock has issued permit 6/8/18.

15) Case No. 17-468-D, involving the denial of a pistol permit to carry pistols and revolvers. The appellant was represented by Attorney Charles K. Thompson. Ofc. Phillips represented the Local Issuing Authority, Chief Anthony Campbell, New Haven Police Department.

Continued: Continued to next available hearing date.

16) Case No. 18-244-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Sgt. Monahan represented the local Issuing Authority, Acting Chief Fernando Spagnolo, Waterbury Police Department.

Decision: By a majority vote, the Board voted in favor of the appellant and ordered Waterbury to issue the pistol permit. Chairman Frank Blando, Ms. Gudrun Johnson, Dr. William Sledge, and Mr. Peter Kuck voted in favor of the appellant and Chief Carl Rosensweig voted against the appellant.

Secretary’s Report:

Board member Johnson made a motion to accept the April 26, 2018 minutes as submitted, Mr. Kuck seconded the motion, motion carried.

Adjournment: Board member Kuck made a motion to adjourn,   Ms. Johnson seconded the motion, motion carried. Meeting ended at 1:05pm
