BOARD OF FIREARMS PERMIT EXAMINERS

Thursday, January 25, 2018, 10am at the

Wethersfield Police Department, 250 Silas Deane Hwy.

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call.  Seven appellants were present, one appellant failed to appear and two cases were resolved the day before the hearing. The State Issuing Authority and six local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf, Dr. William Sledge, Chief Carl Rosensweig, Mr. M. Peter Kuck and Carolyn Futtner, Esq.

Board Members Absent: Ms. Gudrun Johnson.

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Nine cases were heard in the following order:

1) Case No. 16-386-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. Attorney Ralph Sherman represented the appellant. Chief Clark was present for the local Issuing Authority Chief Steven Clark, Newington Police Department.

Withdrawal: The appellant withdrew his appeal.

2) Case No. 17-196-D, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Emerman represented the local Issuing Authority, Chief Brent Larrabee, East Haven Police Department.

Motion: Board Member Kuck made a motion in favor of the appellant seconded by Col. Overturf. Motion carried unanimously.

3) Case No. 17-258-D, involving the denial of a temporary pistol permit to carry pistols and revolvers.  The appellant represented himself..  Lt. Larose represented the local Issuing Authority, Chief Patrick Ridenhour, Danbury Police Department.

Continued: Case has been continued until March 22, 2018

4) Case No. 17-742-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. Attorney Ralph Sherman represented the appellant.  Chief Clark was present for the local Issuing Authority Chief Steven Clark, Newington Police Department.

Continued: Case has been continued until April 12, 2018

5) Case No. 17-130-D, involving the denial of a temporary pistol permit to carry pistols and revolvers.  The appellant represented herself. Lt. Arthur Weisgerber represented the local Issuing Authority, Chief Thomas Kulhawik, Norwalk Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, the denial of the pistol permit, at this time.

6) Case No. 17-219-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Lt. Arthur Weisgerber represented the local Issuing Authority, Chief Thomas Kulhawik, Norwalk Police Department.

Decision: By majority decision, the Board voted in favor of the appellant and ordered Norwalk to issue the permit. Board member Atty. Futtner and Mr. Kuck voted against the appellant and Chairman Blando, Secretary Col. Overturf and Chief Rosensweig voted in favor of the appellant. Dr. Sledge abstained from the vote.

7) Case No. 17-132-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. Attorney Ralph Sherman represented the appellant.  Cpt. Jeff Golden represented the local Issuing Authority, Chief Carl Sferrazza, Enfield Police Department with one witness.

Decision: By majority decision, the Board voted in favor of the appellant and ordered Enfield to issue the permit Chief Rosensweig, Dr. Sledge, and Atty. Futtner voted against the appellant and Chairman Blando, Mr. Kuck, and Col. Overturf voted in favor of the appellant. Due to tie vote Enfield is ordered to issue the appellant his permit.

8) Case No. 17-265-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. First Selectwoman Bonnie Reemsnyder, represented the Issuing Authority, Town of Old Lyme.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered Old Lyme to issue the permit.

9) Case No. 17-259-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. Attorney Ralph Sherman represented the appellant. Sgt. Mark Juhola  represented the local Issuing Authority, Town of Montville.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, the denial of the pistol permit, at this time.

Secretary’s Report:

Board member Col. Overturf made a motion to accept the January 25, 2018 minutes as submitted, Chief Rosensweig seconded the motion, motion carried.

Adjournment: Board member Kuck made a motion to adjourn, Board Member Col. Overturf seconded the motion, motion carried. Meeting ended at 1:55pm
