Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call.  Fifteen appellants were present, four appellant failed to appear. The State Issuing Authority and fourteen local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf, Carolyn Futtner Esq., Dr. William Sledge, Chief Carl Rosensweig and Gudrun Johnson.

Board Members Absent: Mr. M. Peter Kuck

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Nineteen cases were heard in the following order:

1) Case No. 18-203-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Lt. Suski represented the local Issuing Authority, Chief John Daly, Southington Police Department. Atty. Futtner recused herself from this case.

Motion: Secretary Col. Kyle Overturf made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Gudrun Johnson, motion passed unanimously.

2) Case No. 17-056-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant was represented by Michael Dolan, Esq. Sgt. Alex Giannone represented the State Issuing Authority, Acting Commissioner William J. Hackett, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit.

3) Case No. 18-174-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq. with one witness.  Chief Raymond Osborne represented the local Issuing Authority, Chief Raymond Osborne, Darien Police Department with two witnesses.

Decision: By a unanimous decision, the Board voted in favor of the appellant and order Darien to issue the permit.

4) Case No. 17-013-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Acting Commissioner William J. Hackett, Department of Emergency Services and Public Protection.

Decision: This case has been marked off.

5) Case No. 17-734-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear.  Acting Commissioner William J. Hackett, Department of Emergency Services and Public Protection with one witness.

Motion: Secretary Col. Kyle Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Gudrun Johnson, motion passed unanimously.

6) Case No. 18-102-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Ofc. Wityak was present for the local Issuing Authority, Chief Anthony Campbell, New Haven Police Department.

Motion: Secretary Col. Kyle Overturf made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Gudrun Johnson, motion passed unanimously.

7) Case No. 17-140-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Acting Commissioner William J. Hackett, Department of Emergency Services and Public Protection.

Motion: Chief Carl Rosensweig made a motion for the State Issuing Authority, due to the fact the appellant is still under a Risk Warrant, 2nd by Board member Gudrun Johnson.  After discussion the Board voted in favor of the State Issuing Authority by majority vote.  Col. Kyle Overturf, Chief Carl Rosensweig, Ms.Gudrun Johnson, and Atty. Carolyn Futtner voted in favor of the State Issuing Authority.  Chairman Frank Blando voted in favor of the appellant. Dr. William Sledge abstained. Vote was 4-1-1.

8) Case No. 17-541-D, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Acting Commissioner William J. Hackett, Department of Emergency Services and Public Protection.

Continued: This case was continued to February 7, 2019

9) Case No. 18-263-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear.  Tpr. Eklund represented the local Issuing Authority, Town Manager Steven Werbner, Town of Tolland.

Motion: Secretary Col. Kyle Overturf made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Dr. William Sledge, motion passed unanimously.

10) Case No. 17-752-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Sgt. Steven Krzanowski appeared for the local Issuing Authority, Acting Chief Wayne Newkirk, Torrington Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit.

11) Case No. 18-192-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Michael Panton appeared for the local Issuing Authority, Chief Joseph McNeil, Stratford Police Department.

Withdraw: The appellant withdrew his case.

12) Case No. 18-194-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq. Lt. Suplee appeared for the local Issuing Authority, Chief Paul Hammick, Bloomfield  Police Department.

Motion: Motion made by Board Secretary Col. Kyle Overturf to find in favor of the appellant, 2nd by Ms. Gudrun Johnson, motion passed unanimously.

13) Case No. 18-137-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Suplee appeared for the local Issuing Authority, Chief Paul Hammick Bloomfield Police Department.

Motion: Motion made by Board Secretary Col. Kyle Overturf to find in favor of the appellant, 2nd by Ms. Gudrun Johnson, motion passed unanimously.

14) Case No. 18-165-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Tpr. Dunchee represented the local Issuing Authority, First Selectman Amy Traversa, Town of Marlborough.

Decision: By a unanimous decision, the Board voted in favor of the appellant and order Marlborough to issue the permit.

15) Case No. 18-316-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Det. Michael Panton appeared for the local Issuing Authority, Chief Joseph McNeil, Stratford Police Department.

Decision: By a unanimous decision, the Board voted in favor of the appellant and order Stratford to issue the permit.

16) Case No. 18-103-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by James A. Saraceni, Esq. Det. Marcus appeared for the local Issuing Authority, Chief Patrick Ridenhour, Danbury Police Department.

Decision: By a majority decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit. Board Secretary Kyle Overturf, Atty. Carolyn Futtner, Chief Carl Rosensweig, Ms. Gudrun Johnson, and Dr. William Sledge voted in favor of the Local Issuing Authority. The Board Chairman Frank Blando, Esq. voted in favor of the appellant. Vote was 5-1.

17) Case No. 18-270-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Tpr. Adams appeared for the local Issuing Authority, First Selectman Thomas Sparkman, Town of Lisbon.

Motion: Motion made by Board Secretary Col. Kyle Overturf to find in favor of the appellant, 2nd by Ms. Gudrun Johnson, motion passed unanimously.

18) Case No. 18-335-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Lt. Weisgerber appeared for the local Issuing Authority, Acting Chief Thomas Kulhawik, Norwalk Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit.

19) Case No. 18-151-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Ofc. Caserta appeared for the local Issuing Authority, Chief Jonathan Fontneau, Stamford Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit at this time.

Secretary’s Report:

Board Secretary Col. Kyle Overturf made a motion to accept the minutes from November 15, 2018, seconded by Board member Ms. Gudrun Johnson, motion carried.

New Business: Board Secretary Kyle Overturf voted to approve the 2019 Hearing Schedule, 2nd by Ms. Gudrun Johnson, motion carried unanimously.

Adjournment: Board Secretary Kyle Overturf made a motion to adjourn. Seconded by Ms. Gudrun Johnson motion carried. Meeting ended at 3:15pm.
