BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call.  Nine appellants were present, two appellant failed to appear and one case were resolved the day before the hearing. The State Issuing Authority and six local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf., Dr. William Sledge, Chief Carl Rosensweig, and Mr. M. Peter Kuck .

Board Members Absent: Ms. Gudrun Johnson

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Twelve cases were heard in the following order:

1) Case No. 16-286-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. Putting on the record, the attorney, Ralph D. Sherman, testified that Plainfield police department issued the appellant his permit the previous day.

Withdrawal: Case was withdrawn

2) Case No. 16-298-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Agreement: The appellant withdrew his appeal the state will reissue.

3) Case No. 16-412-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Board Member Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.

4) Case No. 16-572-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  First Selectman Leo Paul and Resident State Trooper James Holm represented the local Issuing Authority, Town of Litchfield, First Selectman Leo Paul.

Withdrew: Appellant withdrew his case.

5) Case No. 16-581-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Peperini and Lt. Powers appeared for the local Issuing Authority, Chief Patrick Daley, Norwich Police Department.

Withdrew: Appellant withdrew his case.

6) Case No. 16-422-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq..  Chief James Kenny represented the local Issuing Authority, Chief James Kenny, Vernon Police Department with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, Vernon Police Department, the denial of the pistol permit.

7) Case No. 16-456-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Hector Cardona represented the local Issuing Authority, Chief Jeffry Cossette, Meriden Police Department.

Motion: Board Member Overturf made a motion for the local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.

8) Case No. 16-579-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  . No one was present for the local Issuing Authority, First Selectman, Susan Chapman, Town of New Fairfield.

Motion: Board Member Kuck made a motion for the appellant due to the local Issuing Authority failing to appear.  Motion was seconded by Col. Overturf, motion passed unanimously.

9) Case No. 16-568-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq..  Chief Heavey represented the local Issuing Authority, Greenwich Police Department.

Decision: By a unanimous decision, the Board voted for the appellant and ordered Greenwich to issue the appellant his pistol permit.

10) Case No. 16-339-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit.

11) Case No. 16-271-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit.

12) Case No. 16-487-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Sgt. Peperini and Lt. Powers appeared for the local Issuing Authority, Chief Patrick Daley, Norwich Police Department.

Decision: By a unanimous decision, the Board voted for the appellant and ordered Norwich to issue the appellant his pistol permit.

Secretary’s Report:

Board member Dr. Sledge made a motion to accept the September 21, 2017 minutes as submitted, Col. Overturf seconded the motion, motion carried. Board member Johnson abstained from the vote.

New Business:

Marked off Executive Session-motion by Col. Overturf and seconded by Mr. Kuck.

The Chairman was approached by an appellant’s father and was told how impressed he was with the process of the Board, the Board members and their mission. Chairman Blando congratulated the Board on their hard work and dedication.

Adjournment: Board Member Kuck made a motion to adjourn, Board Member Rosensweig seconded the motion, motion carried. Meeting ended at 2:05pm.
