BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call.  Nine appellants were present, five appellant failed to appear. The State Issuing Authority and eight local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf, Ms. Gudrun Johnson, Mr. M. Peter Kuck and Chief Carl Rosensweig.

Board Members Absent: Dr. William Sledge.

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Fourteen were heard in the following order:

1) Case No. 16-499-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Sgt. Cardona represented the local Issuing Authority, Chief Jeffry Cossette, Meriden Police Department.

Withdrawal: The appellant withdrew his appeal.

2) Case No. 16-330-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the state Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Withdrawal: The appellant withdrew his appeal.

3) Case No. 16-391-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the state Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Agreement: State will issue, appellant withdrew his appeal.

4) Case No. 17-027-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Chief Neil Dryfe represented the local Issuing Authority, Chief Neil Dryfe, Cheshire Police Department.

Withdrawal: The appellant withdrew his appeal.

5) Case No. 16-337-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear, Sgt. Alex Giannone represented the state Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Board Member Overturf made a motion for the state Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.

6) Case No. 16-270-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear, Sgt. Alex Giannone represented the state Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Board Member Overturf made a motion for the state Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.

7) Case No. 16-455-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the state Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the state Issuing Authority, the revocation of the pistol permit at this time.

8) Case No. 17-612-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. Attorney Ralph Sherman represented the appellant with 4 witnesses. Det. Peter Kingston represented the local Issuing Authority, Chief Robert Gagne, Orange Police Department.

Decision: By majority votes the Board found in favor for the appellant. Col. Overturf, Board member Kuck and Chief Rosensweig found in favor of the appellant and Chairman Blando and Ms. Johnson voted against the appellant.

9) Case No. 16-292-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear, Sgt. Alex Giannone represented the state Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Board Member Overturf made a motion for the state Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.

10) Case No. 17-031-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear.  First Selectman Leonard Assard represented the local Issuing Authority, Town of Bethlehem.

Motion: Board Member Overturf made a motion for the local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.

11) Case No. 17-032-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear.  First Selectman Leonard Assard represented the local Issuing Authority, Town of Bethlehem.

Motion: Board Member Overturf made a motion for the local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.

12) Case No. 17-009-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Sgt. Cardona represented the local Issuing Authority, Chief Jeffry Cossette, Meriden Police Department.

Agreement: Meriden will issue, appellant withdrew his appeal.

13) Case No. 16-526-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Sgt. Cardona represented the local Issuing Authority, Chief Jeffry Cossette, Meriden Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, the denial of the pistol permit at this time.

14) Case No. 17-696-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Com. Roberto Rinaldi and Chief Metzler represented the local Issuing Authority, Chief Michael Metzler, Seymour Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, the denial of the pistol permit.

Secretary’s Report:

Board member Col. Overturf made a motion to accept the October 5, 2017 minutes as submitted, Chief Rosensweig seconded the motion, motion carried. Board member. Johnson abstained from the vote.
