BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call.  Five appellants were present, two appellant failed to appear. The State Issuing Authority and five local Issuing Authorities were present and one failed to appear.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf, Ms. Gudrun Johnson, Mr. M. Peter Kuck and Chief Carl Rosensweig.

Board Members Absent: Dr. William Sledge

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Seven cases were heard in the following order:

1) Case No. 16-405-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Withdrew:  The appellant withdrew his case.

2) Case No. 17-060-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. A representative for the local Issuing Authority also failed to appear for First Selectman Tom Weik, Town of Morris.

Motion: Board Member Chief Rosensweig made a motion for the local Issuing Authority, due to the appellant having a misdemeanor handgun disqualifier. Motion was seconded by Board Member Kuck, motion passed unanimously.

3) Case No. 17-075-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. Attorney Donald Celotto represented the appellant. Chief Neil Dryfe represented the local Issuing Authority, Chief Neil Dryfe, Cheshire Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, the denial of the pistol permit.

4) Case No. 17-061-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Chief Jeffrey Finch represented the local Issuing Authority, Chief Jeffrey Finch, Bethel Police Department.

Motion: Board Member Kuck made a motion for the local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Overturf, motion passed unanimously.

5) Case No. 16-546-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Lt. Ash represented the local Issuing Authority, Chief Shawn Boyne, New Milford Police Department with one witness.

Decision: By a majority decision, the Board voted to uphold the decision of the local Issuing Authority, the denial of the pistol permit at this time. Chairman Blando found in favor of the appellant and Secretary Col. Overturf, Board members Mr. Kuck, Ms. Johnson, and Chief Rosensweig vote against the appellant.

6) Case No. 17-014-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Det. Sgt. Hector Cardona represented the local Issuing Authority, Chief Jeffry Cossette, Meriden Police Department.

Decision: By a majority decision, the Board voted in favor of the appellant.  Secretary Col. Overturf and Chief Rosensweig voted against the appellant and Chairman Blando, Ms. Johnson and Mr. Kuck found in favor of the appellant.

7) Case No. 16-575-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf with one witness. Dep. Robert Chief Desena represented the local Issuing Authority with two witnesses, Chief John Gavallas, Watertown Police Department.

Motion: Secretary Col. Overturf made a motion in favor of the appellant. Board Member Johnson seconded the motion, motion passed unanimously.

Secretary’s Report:

Board member Col. Overturf made a motion to accept the October 19, 2017 minutes as submitted, Ms. Johnson seconded the motion, motion carried unanimously.

Adjournment: Board Member Kuck made a motion to adjourn, Board Member Overturf seconded the motion, motion carried. Meeting ended at 12:35pm.
