BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call.  Fifteen appellants were present, two appellant failed to appear. The State Issuing Authority and twelve local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col Kyle Overturf., James A. Greer, Esq., Mr. M. Peter Kuck and Chief Carl Rosensweig.

Board Members Absent: Ms. Gudrun Johnson, Dr. William Sledge.

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Seventeen cases were heard in the following order:

1) Case No. 16-069-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his appeal.

2) Case No. 16-252-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Sgt. Albert Russo represented the local Issuing Authority, Chief Patrick Ridenhour, Danbury Police Department.

Decision: By a majority decision the Board decided to find for the appellant. Chairman Blando, Secretary Col. Overturf, Mr. Kuck and Chief Rosensweig voted for the appellant and Atty Greer voted against the appellant.

3) Case No. 15-265-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with two witnesses.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit.

4) Case No. 15-490-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant  failed to appear.  Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion:  Secretary Overturf made a motion to uphold the revocation due to the appellants failure to appear at the hearing, seconded by Atty. Greer. Motion carried unanimously.

5) Case No. 16-085-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant  failed to appear.  Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion:  Secretary Overturf made a motion to uphold the revocation due to the appellants failure to appear at the hearing, seconded by Mr. Kuck. Motion carried unanimously.

6) Case No. 16-300-D, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Albert Russo represented the local Issuing Authority, Chief Patrick Ridenhour, Danbury Police Department.

Motion:  Secretary Overturf made a motion to find in favor of the appellant seconded by Mr. Kuck. Motion carried unanimously.

7) Case No. 16-019-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his appeal.

8) Case No. 16-195-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Officer James McKeown represented the local Issuing Authority, Chief Paul Melanson,, Farmington Police Department.

Withdrawal: The appellant withdrew his appeal.

9) Case No. 16-193-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Officer James McKeown represented the local Issuing Authority, Chief Paul Melanson, Farmington Police Department.

Withdrawal: The appellant withdrew his appeal. Farmington will issue.

10) Case No. 17-437-CD, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf.  Sgt. Francis Monahan represented the local Issuing Authority, Chief Vernon Riddick, Waterbury Police Department with one witness.

Decision: By a unanimous decision, the Board voted for the appellant.and ordered the permit to be issued.

11) Case No. 16-276-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf.  Trp. Kevin Ekland represented the local Issuing Authority, Town Manager Steven Werbner, Town of Tolland.

Decision: By a majority vote, the Board voted for the appellant. Col. Overturf voted against appellant, Chairman Blando and Board members Greer, Kuck, and Rosensweig.

12) Case No. 16-259-D involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Sgt. Kelly Crandall represented the local Issuing Authority, Chief Louis Fusaro, Jr., Groton Town Police Department.

Motion:  Secretary Overturf made a motion to find in favor of the appellant seconded by Atty. Greer.  Motion carried unanimously.

13) Case No. 16-231-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Atty. Martin Rizzi.  Atty. Scully represented the local Issuing Authority, Chief James Wardwell, New Britain Police Department with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority.

14) Case No. 16-212-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Officer Anthony Popolizio represented the local Issuing Authority, Acting Chief Thomas Wydra, Hamden Police Department..

Motion: Motion:  Board member Kuck made a motion to find in favor of the appellant seconded by Atty. Greer.  Motion carried unanimously.

15) Case No. 17-358-CD, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Officer  Brian Phillips represented the local Issuing Authority, Acting Chief Anthony Campbell, New Haven Police Department..

Motion:  Board member Kuck made a motion to find in favor of the appellant seconded by Atty. Greer.  Motion carried 3-2 in favor of the appellant. Chairman Blando and Chief Rosensweig voted against the appellant and Board members Greer, Kuck and Overturf voted in favor of the appellant.

16) Case No. 17-500-CD, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Francis Monahan represented the local Issuing Authority, Chief Brian Gould, Waterbury

Decision: By a unanimous decision, the Board voted for the appellant.and ordered the permit to be issued.

17) Case No. 16-314-D, involving the denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Sgt. Donald Bensey represented the local Issuing Authority, Chief Armando Perez, Bridgeport Police Department.

Continuance: Will continue this case June 22, 2017

Secretary Overturf made a motion to accept the April 27, 2017 minutes as submitted, Board Member Greer seconded the motion, motion carried.
