BOARD OF FIREARMS PERMIT EXAMINERS

Thursday, July 13, 2017, 10am at the

Wethersfield Police Department, 250 Silas Deane Hwy.

Wethersfield, CT 06109

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call.  Five appellants were present.. The State Issuing Authority and three local Issuing Authorities were present one failed to show.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf, Dr. William Sledge,  Ms. Gudrun Johnson, Mr. M. Peter Kuck and Chief Carl Rosensweig.

Board Members Absent: Attorney Jay Greer was absent.

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Five were heard in the following order:

1) Case No. 16-457--D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Lt. Nick Parham represented the local Issuing Authority, Chief Louis Fusaro, Jr., Groton Town Police Department.

Motion: Board Member Kuck made a motion to find for the appellant due to the Issuing Authority failing to present evidence or facts that prove the appellant is unsuitable. Board Member Johnson seconded the motion, motion carried unanimously.

2) Case No. 16-323-D, involving the denial of a temporary pistol permit to carry pistols and revolvers.. The appellant was represented by Ralph D. Sherman, Esq.. Lt. Timothy Juergens represented the local Issuing Authority, Chief Scott Sansom, East Hartford Police Department with 1 witness..

Decision: By a majority decision, the Board voted for the appellant and ordered East Harford to issue the permit.  Chairman Blando, Secretary Overturf, Mr. Kuck, Chief Rosensweig and Ms. Johnson voted for the appellant and Dr. Sledge voted against the appellant.

3) Case No. 16-225-R,, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witnesses.

Withdrawal: The appellant withdrew his appeal.

4) Case No. 16-326-D, involving the denial of a temporary pistol permit to carry pistols and revolvers.  The appellant appeared on his own behalf.   First Selectman James Hayden represented the local Issuing Authority along with Resident State Trooper Kevin Jones.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, the denial of the pistol permit, at this time.

5) Case No. 17-568-D, involving the denial of a temporary pistol permit to carry pistols and revolvers.  The appellant appeared on his own behalf. The local Issuing Authority, Chief Thomas Kulhawik, Norwalk Police Department failed to appear.

Motion: Mr. Kuck made a motion to find for the appellant, seconded by Col. Overturf.  Motion withdrawn and discussed the plan to continue the case.

Continue: Case will be continued until September 7, 2017.

Secretary’s Report:

Board member Kuck made a motion to accept the June 22, 2017, minutes as submitted, Dr. Sledge seconded the motion, motion carried.

Adjournment: Board Member Kuck made a motion to adjourn, Ms. Johnson seconded the motion, motion carried. Meeting ended at 12:35pm
