BOARD OF FIREARMS PERMIT EXAMINERS

Thursday, April 27, 2017, 10am at the

Wethersfield Police Department, 250 Silas Deane Hwy.

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call.  Eight appellants were present, two appellant failed to appear. The State Issuing Authority and seven local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf., James A. Greer, Esq., Mr. M. Peter Kuck, Chief Carl Rosensweig and. Dr. William Sledge.

Board Members Absent: Ms. Gudrun Johnson.

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Ten were heard in the following order:

1) Case No. 15-410-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew her appeal.

2) Case No. 16-040-D, involving the denial of a temporary pistol permit to carry pistols and revolvers.  The appellant appeared on his own behalf. Winchester failed to appear as they had knowledge of appellant moving to a different town.

Withdrawal: The appellant withdrew his appeal.

3) Case No. 15-396-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to show. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Board Secretary Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Greer, motion passed unanimously.

4) Case No. 15-399-R, involving the revocation of a pistol permit to carry pistols and revolvers. Attorney William J. Nulsen represented the appellant Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his appeal through Sgt. Giannone as both parties had already left.

5) Case No. 16-229-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Russo appeared for the Local Issuing Authority, Chief Patrick Ridenhour Danbury Police Department.

Motion: Board Secretary Overturf made a motion for the local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Chief Rosensweig, motion passed unanimously.

6) Case No. 17-026-CD, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Lt. Arthur Weisgerber represented the Local Issuing Authority, Chief Thomas Kulhawik, Norwalk Police Department.

Motion: Motion made by Board member Kuck to continue this case to August 10, 2017 seconded by Dr Sledge. Motion passed unanimously.

7) Case No. 17-255-CD, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf with one witness. Sgt. Francis Monahan represented the local Issuing Authority, Chief Vernon Riddick, Waterbury Police Department.

Decision: By majority decision, the Board decided to uphold the denial for the Local Issuing Authority. Chairman Blando, Secretary Overturf, Board members Chief Rosensweig, Attorney Greer and Dr. Sledge voted against the appellant and Board member Kuck voted in favor of the appellant.

8) Case No. 16-010-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.. Det. Weir appeared for the Local Issuing Authority, Chief Michael Lombardo Trumbull Police Department.

Motion:  Motion made for the appellant by Col. Overturf seconded by Mr. Kuck.  Motion passed unanimously.

9) Case No. 16-230-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Jurgenes appeared for the Local Issuing Authority, Chief Scott Sansom, East Hartford Police Department.

Motion:  Motion made for the appellant by Mr. Kuck seconded by Col. Overturf.  Motion passed unanimously.

10) Case No. 16-217-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Officer Popolizio appeared for the Local Issuing Authority, Chief Thomas Wydra, Hamden Police Department.

Decision: By a unanimous decision, the Board voted for the appellant and ordered the town of Hamden to issue the permit.

Secretary’s Report:

Chief Rosensweig made a motion to accept the amended April 13, 2017 minutes as submitted, Board Secretary Overturf seconded the motion, motion carried.

New Business:

Motion: Secretary Overturf made a motion to go into Executive Session pursuant to C.G.S. 1-200(6), C.G.S. 1-200(8), and C.G.S. 1-200(9)(C) relative to matter 17-209-CD,. Board Member Kuck seconded the motion, motion carried unanimously.

Motion: Secretary Overturf made a motion to come out of Executive Session, Board Member Kuck seconded the motion, motion carried unanimously.

Office manager will contact Attorney General on case 17-209-CD

Adjournment: Board Member Kuck made a motion to adjourn, Board Member Overturf seconded the motion, motion carried. Meeting ended at 12:30pm.
