BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Swearing in of Dr. William Sledge to the Board of Firearms Permit Examiners

Chairman Blando read the Introductory Statement and called the roll call.  Seven appellants were present, one appellant failed to appear. The State Issuing Authority and five local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf, Dr. William Sledge, James A. Greer, Esq., Ms. Gudrun Johnson, Mr. M. Peter Kuck and Chief Carl Rosensweig.

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Eight cases were heard in the following order:

1) Case No. 16-131-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Leo Clarke represented the local Issuing Authority, Chief James Rovella Hartford Police Department.

Withdrawal: The appellant withdrew his appeal.

2) Case No. 15-423-R, involving the State denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with three witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit at this time.

Dr. Sledge left the meeting

3) Case No. 16-176-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. The Issuing Authority failed to appear, First Selectman Susan Chapman,  Town of New Fairfield.

Motion: Board Secretary Overturf made a motion for the appellant by default, due to the local Issuing Authority failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.

4) Case No. 16-026-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Detective Steven Pileski represented the local Issuing Authority, Chief Brian Gould Bristol Police Department.

Motion: Board Secretary Overturf made a motion for the local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Johnson, motion passed unanimously.

Ms. Johnson left the meeting.

5) Case No. 15-344-R, involving the denial of a temporary pistol permit to carry pistols and revolvers. Attorney Guy Soares represented the appellant. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Agreement: Appellant withdrew, agreement made with the State Police.

6) Case No. 16-168-D involving the denial of a temporary pistol permit to carry pistols and revolvers. Attorney Guy Soares represented the appellant. Assistant Chief Anthony Cuozzo represented the local Issuing Authority, Chief Robert Gagne, Orange Police Department.

Withdrawal: The appellant withdrew his appeal.

7) Case No. 16-009-D involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Off. Daniel Janco represented the local Issuing Authority, First Selectman, Daniel Jarram, Town of New Hartford.

Decision: By a majority decision, the Board voted to uphold the decision of the local Issuing Authority, First Selectman, Daniel Jerram  of the denial of his pistol permit at this time. Board members Blando, Greer, Overturf and Rosensweig voted against the appellant and Board member Kuck vote in favor of the appellant.

8) Case No. 16-148-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. First Selectman Craig Baldwin represented the local Issuing Authority, Town of Pomfret.

Decision: By a unanimous decision, the Board voted for the appellant and the permit to be issued.

Secretary’s Report:

Secretary Overturf made a motion to accept the March 23, 2017 minutes as submitted, Board Member Greer seconded the motion, motion carried.

New Business: Discussion for new language on our Policies and Procedures pertaining to sharing information between the Issuing Authority and the appellants.

Col Overturf made a motion to accept the propose language for the Policies and Procedures 4-1 Reciprocal Disclosure with a second by Chief Rosensweig. Motion carried unanimously. 

Adjournment: Board Member Kuck made a motion to adjourn, Board Member Greer seconded the motion, motion carried. Meeting ended at 1:25pm.
