BOARD OF FIREARMS PERMIT EXAMINERS

Wethersfield Police Dept., Wethersfield, CT 06109

Call to Order

Chairman Frank Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement called the roll call. 9 appellants were present. The State Issuing Authority and 5 local Issuing Authorities were present 1 failed to show.

Board Members Present: Chairman Frank Blando, Craig C. Fishbein, Esq., Ms. Gudrun Johnson, Col. Kyle Overturf, Chief Carl Rosensweig, Peter Kuck and James Greer, Esq.

Board Members Absent: Dr. Charles Dike

Chairman Blando administered the oath to all witnesses.

Hearings: 9 cases were heard in the following order:

1) Case No. 15-393-D involving the denial of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Resident Trooper Eklaund represented the Issuing Authority, Tolland Town Manager, Steven Werbner.

Withdrawl: Appellant withdrew

2) Case No. 15-448-D, involving the denial of his pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Detective Mark Lemieux was present for the local Issuing Authority, Chief William McKenna, Middletown Police Department.

Motion: Motion made for the appellant by Secretary Fishbein, seconded by Board Member Johnson, motion carried unanimously.

3) Case No. 16-209-CD, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. The local Issuing Authority failed to appear, Chief Brian Gould, Bristol Police Department.

Agreement: Chairman Blando made a suggestion to continue until the November 17, 2016 hearing, so the Issuing Authority can explain the denial of the appellants pistol permit.

4) Case No. 15-053-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.. Sgt. Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Dept. of Emergency Services and Public Protection.

Withdrawl: Appellant withdrew, state will reissue

5) Case No. 15-240-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Dept. of Emergency Services and Public Protection.

Withdraw: Board member Kuck made a motion to table this case, motion failed. Appellant withdrew.

6) Case No. 16-202-D, involving the denial of his pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq. Atty. Forsythe represented the local Issuing Authority, First Selectman Theodore Shafer, Town of Burlington.

Decision: Secretary Fishbein made a motion for a continuance, seconded by Chief Rosensweig. Following a discussion, Chief Rosensweig withdrew his second on the motion. Due to lack of seconded to the motion the motion failed.

By majority decision, the Board decided to uphold the denial for the Local Issuing Authority. Board members Greer, Johnson, Overturf and Rosensweig voted against the appellant. Chairman Blando and Board members Fishbein and Kuck voted in favor of the appellant.

7) Case No. 15-320-D involving the denial of his pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Chief John Rich appeared as the local Issuing Authority, in the town of Ledyard.

Withdrawl: Appellant withdrew

8) Case No. 15-342-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Dept. of Emergency Services and Public Protection with 1 witness.

Decision: Motion made by Board Member Chief Rosensweig seconded my Mr. Kuck to uphold the revocation for the State Issuing Authority. By majority decision, the Board decided to uphold the revocation. Board members Greer, Johnson, Overturf Kuck and Rosensweig voted against the appellant. Chairman Blando and Board member Fishbein voted in favor of the appellant.

9) Case No. 15-187-D, involving the denial of his pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq. Off. Sheehan represented the local Issuing Authority, Chief Matthew Canelli, North Branford Police Department.

Decision: Motion made by Secretary Fishbein seconded by Ms. Johnson to find for the appellant. Motion carried unanimously.

Secretary’s Report:

Secretary Fishbein made a motion to accept the October 13, 2016 minutes as written, Board Member Greer seconded the motion, Chairman Blando and Mr. Kuck abstained. Motion approved

Adjournment: Secretary Fishbein made a motion to adjourn, Board Member Greer seconded the motion, motion carried. Meeting adjourned at 2:25.
