BOARD OF FIREARMS PERMIT EXAMINERS

Tuesday, August 16, 2016, 10am at the

Dept. of Emergency Services and Public Protection, Middletown, CT

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call. Two appellants were present and one withdrew. Three local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Craig C. Fishbein, Esq., Ms. Gudrun Johnson, Mr. M. Peter Kuck, Col. Kyle Overturf and Chief Carl Rosensweig.

Board Members Absent: Dr. Charles Dike and James A. Greer, Esq.

Chairman Blando administered the oath to all witnesses.

Hearings: Three cases were heard in the following order:

1) Case No. 14-511-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. Attorney Glen Conway represented the appellant. Sgt. Monahan represented the local Issuing Authority, Chief Vernon Riddick, Waterbury Police Department with two witnesses. 

Motion: Board Member Kuck made a motion in favor of the appellant due to insufficient evidence. Motion failed due to lack of a second to the motion.

Decision: By a majority, the Board voted to overturn the decision of the local Issuing Authority, Chief Vernon Riddick, Waterbury Police Department and ordered a temporary pistol permit be issued. Board Member Rosensweig voted for the local Issuing Authority. Board Members Blando, Fishbein, Johnson, Kuck and Overturf voted for the appellant.

2) Case No. 14-468-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. Attorney Glen Conway represented the appellant. Sgt. Monahan represented the local Issuing Authority, Chief Vernon Riddick, Waterbury Police Department. 

Withdrawal: Attorney Conway informed the Board members that his client, the appellant, withdrew his appeal.

3) Case No. 15-232-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Attorney Mark S. Zamarka represented the local Issuing Authority, First Selectman Mark C. Nickerson, Town of East Lyme.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, First Selectman Mark C. Nickerson, Town of East Lyme, the denial of a temporary pistol permit.

Adjournment: Fishbein made a motion to adjourn, Kuck seconded the motion, motion carried. Meeting adjourned.
