BOARD OF FIREARMS PERMIT EXAMINERS

Dept. of Emergency Services and Public Protection, Middletown, CT

Call to Order

Acting Chairman Craig C. Fishbein called the meeting to order at 10:00am.

Acting Chairman Fishbein read the Introductory Statement and called the roll call. Eight appellants were present and four failed to appear. The State Issuing Authority and nine local Issuing Authorities were present. One local issuing authority failed to appear.

Board Members Present: Craig C. Fishbein, Esq., Ms. Gudrun Johnson, Mr. M. Peter Kuck, Col. Kyle Overturf and Chief Carl Rosensweig.

Board Members Absent: Chairman Frank P. Blando, Esq., Dr. Charles Dike and James A. Greer, Esq.

Acting Chairman Fishbein administered the oath to all witnesses

Hearings: Eleven cases were heard in the following order:

1) Case No. 16-322-CD, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Chief James Kenny, the local Issuing Authority, represented the Vernon Police Department with two witnesses.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, Chief James Kenny, Vernon Police Department, the denial of a temporary pistol permit, at this time.

2) Case No. 15-170-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with two witnesses.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, the revocation of the pistol permit, at this time.

3) Case No. 15-238-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. A representative for the local Issuing Authority Chief Michael Spera, Old Saybrook Police Department was in attendance. 

Motion: Board Member Fishbein made a motion to find for the local Issuing Authority, Chief Michael Spera, Old Saybrook Police Department, by default, due to appellant’s failure to appear. Kuck seconded the motion, motion carried.

4) Case No. 15-239-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Board Member Fishbein made a motion to find for the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, by default, due to appellant’s failure to appear. Kuck seconded the motion, motion carried. 

5) Case No. 15-219-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. A representative for the local Issuing Authority Chief John Daly, Southington Police Department was in attendance. 

Motion: Board Member Fishbein made a motion to find for the local Issuing Authority, Chief John Daly, Southington Police Department, by default, due to appellant’s failure to appear. Kuck seconded the motion, motion carried.

6) Case No. 16-514-CD, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant and a representative of the local Issuing Authority, Chief Vernon Riddick, Waterbury Police Department failed to appear.

Motion: Board Member Kuck made a motion for the appellant because neither side was present. Motion failed due to lack of a second to the motion.

Motion: Acting Chairman Fishbein made an executive decision to have the matter go off.

7) Case No. 14-591-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. Attorney Ralph D. Sherman represented the appellant. Det. Scott Segar represented the local Issuing Authority, Chief Tracey Gove, West Hartford Police Department.

Agreement: The appellant and the local Issuing Authority agreed the permit would be issued immediately.

8) Case No. 15-185-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Eric Schneider represented the local Issuing Authority, Chief Armando Perez, Bridgeport Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Chief Armando Perez, Bridgeport Police Department and ordered a temporary pistol permit be issued.

9) Case No. 15-103-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Capt. Jeff Golden represented the local Issuing Authority, Chief Carl Sferrazza, Enfield Police Department.

Decision: By a majority, the Board voted to overturn the decision of the local Issuing Authority, Chief Carl Sferrazza, Enfield Police Department and the Board members ordered a temporary permit to be issued. Board Member Johnson voted for the local Issuing Authority. Board Members Fishbein, Kuck, Overturf and Rosensweig voted for the appellant.

10) Case No. 16-528-CD, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Chief James Campbell, the local Issuing Authority, represented the Thomaston Police Department with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, Chief James Campbell, Thomaston Police Department, the denial of a temporary pistol permit.

11) Case No. 15-045-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. Attorney Ralph D. Sherman represented the appellant. Lt. Heather Desmond represented the local Issuing Authority, Chief William McKenna, Middletown Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, Chief William McKenna, Middletown Police Department, the denial of a temporary pistol permit, at this time.

Secretary’s Report:

Fishbein called for a motion to accept the July 28, 2016 minutes as written, Overturf made the motion, Kuck seconded the motion, motion carried.

Adjournment: Kuck made a motion to adjourn, Johnson seconded the motion, motion carried. Meeting adjourned.
