BOARD OF FIREARMS PERMIT EXAMINERS

Wednesday, October 21, 2015, 10am at the

Wallingford Parks and Recreation Bldg. Wallingford, CT

Call to Order

Chairman Frank P. Blando, called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call. Six appellants were present and three failed to appear. The State Issuing Authority and five local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Craig C. Fishbein, Esq., Ms. Gudrun Johnson, Mr. M. Peter Kuck and Col. Kyle Overturf.

Board Members Absent: Dr. Charles Dike, James A. Greer, Esq., Chief Carl Rosensweig.

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Nine cases were heard in the following order:

1) Case No. 14-573-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. A representative appeared on behalf of the local Issuing Authority, Town Manager Sean Hendricks, Town of Danielson. 

Withdrawal: The appellant withdrew his appeal.

2) Case No. 14-530-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Albert Russo appeared on behalf of the local Issuing Authority, Chief Alan Baker, Danbury Police Department with three witnesses.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, Chief Alan Baker, Danbury Police Department, the denial of a pistol permit at this time.

3) Case No. 14-568-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Attorney Sheffi represented the local Issuing Authority, Chief John Daly, Southington Police Department with three witnesses.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, Chief John Daly, Southington Police Department, the denial of a pistol permit.

4) Case No. 14-513-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with five witnesses.

Motion: Board Member Fishbein made a motion to find for the decision of the State Issuing Authority, Dora B. Schriro, Department of Emergency Services and Public Protection, the revocation of a pistol permit, due to the appellant’s failure to pursue the appeal. The motion was seconded by Board Member Overturf, motion carried unanimously.

5) Case No. 14-039-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Board Member Fishbein made a motion to find for the decision of the State Issuing Authority, Dora B. Schriro, Department of Emergency Services and Public Protection, the revocation of a pistol permit, due to the appellant’s failure to pursue the appeal. The motion was seconded by Board Member Johnson, motion carried unanimously.

6) Case No. 14-439-D, involving the denial of a pistol permit to carry pistols and revolvers. The appellant failed to appear. A representative appeared on behalf of the local Issuing Authority, Chief Brent Larrabee, East Haven Police Department.

Motion: Board Member Fishbein made a motion to find for the decision of the local Issuing Authority, Chief Brent Larrabee, East Haven Police Department, the denial of a pistol permit, due to the appellant’s failure to pursue the appeal. The motion was seconded by Board Member Kuck, motion carried unanimously.

7) Case No. 14-354-R, involving the revocation of a pistol permit to carry pistols and revolvers. Attorney Ralph D. Sherman represented the appellant. Sgt. Alex Giannone represented for the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Continued: Case continued to Dec. 10th.

8) Case No. 14-402-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented for the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Withdrawal: The appellant withdrew his appeal.

9) Case No. 12-110-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Boyko represented the local Issuing Authority, Chief Thomas Grimaldi, Bristol Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Chief Thomas Grimaldi, Bristol Police Department and ordered a temporary pistol permit to be issued.

Secretary’s Report:

1)     Board Secretary Fishbein made a motion to approve the September 24, 2015 minutes as written, Board Member Johnson seconded the motion, motion carried.

2)     Board Secretary Fishbein made a motion to approve the meeting schedule for 2016. Board Member Kuck seconded the motion, motion carried.

Adjournment: Board Member Kuck made a motion to adjourn, Board Member Fishbein seconded the motion, motion carried.
