BOARD OF FIREARMS PERMIT EXAMINERS

Thursday, May 28, 2015, 10am at the

Wethersfield Police Dept., Wethersfield, CT 06109

Call to Order

Chairman Frank P. Blando, called the meeting to order at 10:00am and read the Introductory Statement.

Motion: Board Secretary Fishbein made a motion to wave the rules and add an item on the agenda in order to swear in the new Board member. Board Member Rosensweig seconded the motion, motion carried.

Chairman Blando swore in new member, Dr. Charles Dike, a representative of the Dept. of Mental Health and Addiction Services.

Chairman Blando called the roll call. Five appellants were present and one appellant failed to appear. The State Issuing Authority was present and three local Issuing Authorities were present and two local Issuing Authority failed to appear.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Craig C. Fishbein, Esq., Dr. Charles Dike, James A. Greer, Esq., Ms. Gudrun Johnson, Col. Kyle Overturf and Chief Carl Rosensweig.

Board Members Absent: Mr. M. Peter Kuck

Chairman Blando administered the oath to all witnesses.

Hearings: Six cases were heard in the following order.

1) Case No. 13-687-D, Linda Wilson, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Lt. Kevin McCarthy represented the local Issuing Authority, Chief Tracey Gove, West Hartford Police Department with two witnesses. 

Chief Rosensweig recused himself from the case.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, Chief Shawn Boyne, New Milford Police Department, the denial of a temporary pistol permit.

2) Case No. 14-164-R, Ryshon Penix, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Due to the State Issuing Authority’s witness not being available, Secretary Fishbein made a motion to continue the case to June 11, 2015 and first place on the agenda. Board Member Rosensweig seconded the motion, motion carried.

3) Case No. 14-404-D, Angel Torres, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. A representative from the local Issuing Authority, Chief John Salvatore, Monroe Police Department failed to appear. 

Motion: Secretary Fishbein made a motion to “mark off” the case and to send a letter notifying the appellant that he had 30 days to contact the Board staff or his case would be considered dormant. Board Member Greer second the motion, motion carried.

4) Case No. 1-438-D, Gary Vaillancourt, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Brian Herwerth represented the local Issuing Authority, Chief David Caron, Glastonbury Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Chief David Caron, Glastonbury Police Department, and ordered a temporary pistol permit to be issued to the appellant.

5) Case No. 15-052-CD, Clint Greatorex, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. A representative from the local Issuing Authority, Chief Richard Guisti, Middlebury Police Department failed to appear.

Motion: Secretary Fishbein made a motion in favor of the appellant by default due to a representative from the local Issuing Authority, Middlebury Police Department, had failed to appear. Board Member Overturf seconded the motion, motion carried.

6) Case No. 15-326-CD, Stephen Sosa, involving the denial of a temporary pistol permit to carry pistols and revolvers. Attorney Ralph D. Sherman represented the appellant. Lt. Jamie Del Mauro represented the local Issuing Authority, Chief William McKenna, Middletown Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, Chief William McKenna, Middletown Police Department, the denial of a pistol permit, at this time.

Secretary’s Report:

1)Secretary Fishbein made a motion to accept the April 23, 2015 minutes as written, Greer seconded the motion, motion carried with Board Members Johnson, Overturf and Dike abstaining.

2)Secretary Fishbein made a motion to accept the May 14, 2015 minutes as written, Greer seconded the motion, motion carried with Board Member Dike abstaining.

New Business:

Secretary Fishbein made a motion to meet in Executive Session pursuant to C.G.S. 1-200(8), and C.G.S. 1-200(9)(C) relative to matter Case 14-111-D, Greer seconded the motion, motion carried.

Secretary Fishbein made motion to come out of Executive Session, Greer seconded the motion, motion carried.

Secretary Fishbein made a motion to proceed in the manner that was discussed in Executive Session in regards to Case 14-111-D. Johnson seconded the motion, motion carried.

Adjournment: Fishbein made a motion to adjourn, Johnson seconded the motion, motion carried. Meeting adjourned at 1:30pm.
