BOARD OF FIREARMS PERMIT EXAMINERS

Thursday, June 25, 2015, 10am at the

Wethersfield Police Dept., Wethersfield, CT 06109

Call to Order

Chairman Frank P. Blando, called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call. Four appellants were present and four local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Craig C. Fishbein, Esq., Dr. Charles Dike, James A. Greer, Esq., Ms. Gudrun Johnson, Col. Kyle Overturf and Chief Carl Rosensweig.

Board Members Absent: Mr. M. Peter Kuck

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Four cases were heard in the following order:

1) Case No. 15-350-CD, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Brian Herwerth represented the local Issuing Authority, Chief David Caron, Glastonbury Police Department, with one witness. 

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, Chief David Caron, Glastonbury Police Department, the denial of a temporary pistol permit.

2) Case No. 14-379-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Lt. Brian Herwerth represented the local Issuing Authority, Chief David Caron, Glastonbury Police Department.

Decision: By a majority, the Board voted to uphold the decision of the local Issuing Authority, Chief David Caron, Glastonbury Police Department, the denial of a temporary pistol permit. Blando voted for the appellant. Dike, Fishbein, Greer, Johnson, Overturf and Rosensweig voted for the local Issuing Authority.

3) Case No. 13-168-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Attorney Kim McGee represented the local Issuing Authority, Chief Louis Fusaro, Norwich Police Department, with one witness. 

Withdrawal: The appellant withdrew his appeal and will reapply.

4) Case No. 14-418-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Deputy Chief James Barhaa represented the local Issuing Authority, Chief Joseph Gaudett, Bridgeport Police Department.

Motion: Fishbein made a motion that the previous case, Case No. 12-204-R, be incorporated in the appeal. Rosensweig seconded the motion, motion carried, with Greer abstaining.

Motion: Fishbein made a motion to find for the local Issuing Authority, Chief Joseph Gaudett, Bridgeport Police Department, due to the Board not being able to order a local Issuing Authority to issue a permit to someone who no longer exist. The appellant legally changed his name and the name the appellant had used to appeal the denial no longer exist. Rosensweig seconded the motion, motion carried unanimously.

Secretary’s Report:

Fishbein made a motion to accept the June 11, 2015 minutes as written, Johnson seconded the motion, motion carried with Overturf abstaining.

New Business: Executive Session.

Fishbein made a motion to go into Executive Session pursuant to pursuant to C.G.S. 1-200(6) and C.G.S. 1-200(9)(C) relative to matter 15-048-CD. Greer seconded the motion, motion carried unanimously.

Fishbein made a motion to come out of Executive Session, Greer seconded the motion, motion carried unanimously.

Adjournment: Fishbein made a motion to adjourn, Greer seconded the motion, motion carried. Meeting adjourned at 12:45pm.
