BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Chairman Frank P. Blando, called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call. Seven appellants were present and two failed to appear. The State Issuing Authority was present, four local Issuing Authorities were present and one failed to appear for two cases.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Craig C. Fishbein, Esq., Dr. Charles Dike, James A. Greer, Esq., Ms. Gudrun Johnson, Mr. M. Peter Kuck, Col. Kyle Overturf and Chief Carl Rosensweig.

Chairman Blando administered the oath to all witnesses.

Hearings: Nine cases were heard in the following order:

1) Case No. 14-406-R, involving the revocation of his State pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Fishbein made a motion to order the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection to reinstate the appellant’s State pistol permit within 10 days and should there be an issue, the case would be restored to the Board’s docket. Kuck seconded the motion, motion carried unanimously.

2) Case No. 13-296-R, involving the revocation of his State pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, the revocation of the his State pistol permit, at this time.

3) Case No. 15-324-R, involving the revocation of his State pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with two witnesses.

Decision: By a majority, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, the revocation of his State pistol permit, at this time. Blando voted for the appellant. Dike, Fishbein, Greer, Johnson, Kuck, Overturf and Rosensweig voted for the State Issuing Authority.

4) Case No. 14-102-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. A representative failed to appear for local Issuing Authority, Chief Joseph L Gaudett, Bridgeport Police Department.

Motion: Fishbein made a motion to find in favor of the appellant by default, due to a representative of the local Issuing Authority, Chief Joseph L Gaudett, Bridgeport Police Department, had failed to appear. Kuck seconded the motion, motion carried unanimously.

5) Case No. 14-448-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. A representative failed to appear for the local Issuing Authority, Chief Joseph L Gaudett, Bridgeport Police Department.

Motion: Fishbein made a motion to find in favor of the appellant by default, due to a representative of the local Issuing Authority, Chief Joseph L Gaudett, Bridgeport Police Department, had failed to appear. Johnson seconded the motion, motion carried unanimously.

6) Case No. 14-384-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. A representative appeared for the local Issuing Authority, Chief Dean Esserman, New Haven Police Department.

Motion: Fishbein made a motion to find in favor of the local Issuing Authority, Chief Dean Esserman, New Haven Police Department, by default, due to the appellant’s failure to appear. Dike seconded the motion, motion carried unanimously.

7) Case No. 14-449-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. A representative appeared for the local Issuing Authority, Chief Todd Lawrie, Clinton Police Department.

Motion: Fishbein made a motion to find in favor of the local Issuing Authority, Chief Todd Lawrie, Clinton Police Department, by default, due to the appellant’s failure to appear. Kuck seconded the motion, motion carried unanimously.

8) Case No., 15-486-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Trooper First Class Jeff Dunshee represented the local Issuing Authority, First Selectman Catherine Gaudinski, Town of Marlborough.

Motion: Fishbein made a motion to find in favor of the appellant due to the local Issuing Authority, TFC Dunshee, for First Selectman Catherine Gaudinski, Town of Marlborough, not finding the appellant unsuitable. Greer seconded the motion, motion carried unanimously.

9) Case No. 14-430-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Russo represented the local Issuing Authority, Chief Alan Baker, Danbury Police Department.

Motion: Fishbein made a motion to find for the appellant because Sgt. Russo, representative of the local Issuing Authority, Chief Alan Baker, Danbury Police Department, concedes that the appellant would not be a danger to the public if issued a pistol permit. Greer seconded the motion, motion carried unanimously.

Secretary’s Report:

Fishbein made a motion to accept the June 25, 2015 minutes as written, Johnson seconded the motion, motion carried. Kuck abstained.
