BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Chairman Frank P. Blando, called the meeting to order at 10:10am.

Chairman Frank P. Blando, read the Introductory Statement and called the roll call. Five appellants were present. The State Issuing Authority was present and four representatives from the local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Craig C. Fishbein, Esq., James A. Greer, Esq., Ms. Gudrun Johnson, Mr. M. Peter Kuck and Chief Carl Rosensweig.

Board Members Absent: Dr. Charles Dike and Col. Kyle Overturf

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings:

1) Case No. 13-004-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection

Withdrawal: The appellant withdrew his appeal.

2) Case No. 13-658-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Dexter Herron appeared for the local Issuing Authority, Chief Michael Crowley, Groton Town Police Department.

Motion: Board Member Fishbein made a motion to find for the appellant due to the representative of the local Issuing Authority, Chief Michael Crowley, Groton Town Police Department, failed to prove the appellant is unsuitable. Board Member Greer seconded the motion, motion carried unanimously.

3) Case No. 14-462-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Brian Hubbs appeared for the local Issuing Authority, Chief William McKenna, Middletown Police Department.

Motion: Board Member Fishbein made a motion to find for the appellant due to the representative of the local Issuing Authority, Chief William McKenna, Middletown Police Department, failed to prove the appellant is unsuitable. Board Member Johnson seconded the motion, motion carried unanimously.

4) Case No. 14-470-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Det. Kenneth Jones appeared for the local Issuing Authority, Chief Michael Lombardo, Trumbull Police Department.

Motion: Board Member Fishbein made a motion to find for the appellant due to representative of the local Issuing Authority, Chief Michael Lombardo, Trumbull Police Department, failed to prove the appellant is unsuitable. Board Member Kuck seconded the motion, motion carried unanimously.

5) Case No. 14-366-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. John Theriana appeared for the local Issuing Authority, Chief Patrick Ridenhour, Stratford Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Chief Patrick Ridenhour, Stratford Police Department, the denial of a temporary pistol permit and ordered the temporary pistol permit to be issued.

Secretary’s Report:

Board Secretary Fishbein made a motion to accept the July 9, 2015 minutes as written, Board Member Greer seconded the motion, motion carried unanimously.

New Business: Secretary Fishbein made a motion to go into Executive Session pursuant to C.G.S. 1-200(6), C.G.S. 1-200(8), and C.G.S. 1-200(9)(C) relative to matter Case 15-052-CD.

Secretary Fishbein made a motion to come out of Executive Session, seconded by Board Member Johnson, motion carried unanimously.

Secretary Fishbein made a motion to follow the direction discussed in executive session in regard to Case 15-052-CD. Board Member Johnson seconded the motion, motion carried unanimously.

Adjournment: Secretary Fishbein made a motion to adjourn, Board Member Greer seconded the motion, motion carried. Meeting adjourned at 1:00pm.
