BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Chairman Blando called the meeting to order at 10:04 AM.

Chairman Blando called the roll call and 9 appellants were present.

The State Issuing Authority was present and 3 local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Craig C. Fishbein, Esq.,  Dr. S. David Bernstein, James A. Greer, Esq., Ms. Gudrun Johnson, Mr. M. Peter Kuck , Col. Kyle Overturf and Chief Carl Rosensweig.

Chairman Blando read the Introductory Statement and administered the oath to all witnesses.

Hearings:

1) Case No. 13-279-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora Schriro, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his appeal.

2) Case No. 13-627-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. The Issuing Authority was represented by Chief Michael Metzler, Seymour Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, Chief Michael Metzler, Seymour Police Department, the denial of a temporary pistol permit, at this time.

3) Case No. 13-485-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora Schriro, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his appeal.

4) Case No. 13-562-R involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora Schriro, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his appeal.

5) Case No. 13-271-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Dora Schriro, Department of Emergency Services and Public Protection, the revocation of the appellant’s pistol permit, at this time.

6) Case No. 13-370-D involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Officer Roberts represented the local Issuing Authority, Chief Edward DeMardo Jr., East Windsor Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Chief Edward DeMardo Jr., East Windsor Police Department and voted for the appellant to be issued a temporary pistol permit.

7) Case No. 13-435-D involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Suchecki represented the local Issuing Authority, First Selectman Gregg Schuster, Town of Colchester.

Agreement: The appellant agreed to withdraw his appeal and Sgt. Suchecki representative of the local Issuing Authority, First Selectman Gregg Schuster, Town of Colchester, agreed to issue a temporary pistol permit. Secretary Fishbein made a motion to accept the agreement, Kuck seconded the motion, motion carried.

8) Case No. 13-335-R involving the revocation of her pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Dora Schriro, Department of Emergency Services and Public Protection, the revocation of the appellant pistol permit.

9) Case No. 13-469-R involving the revocation of her pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora Schriro, Department of Emergency Services and Public Protection.

Agreement: The appellant agreed to withdraw her appeal and the State Issuing Authority, Commissioner Dora Schriro, Department of Emergency Services and Public Protection, agreed to reinstate the pistol permit on August 28, 2014 on the condition of the current suitability and that she hasn’t committed any offence that violates the criminal law and doesn’t have any statutory disqualifying events at that time.

Secretary’s Report:

Secretary Fishbein made a motion to approve the January 24, 2014 minutes,  Greer seconded the motion, motion carried.

New Business: Secretary Fishbein made a motion to discuss the closing of 94 dormant cases for failure to pursue the appeal. Greer seconded the motion, motion carried. Office Manager Susan Mazzoccoli explained that all 94 appellants had not responded to the Board with an Appellant Questionnaire.  All 94 appellants were sent a notice with a second Appellant Questionnaire and a 60 day deadline to complete the appeal. Mazzoccoli explained that it has been the Board policy to bring the dormant cases to the Board members for a vote to dismiss for failure to pursue. Overturf made a motion to dismiss the dormant cases for failure to pursue the appeal, Greer seconded the motion, motion carried.

Adjournment: Blando made a motion to adjourn, Greer seconded the motion, motion carried.
