BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Chairman Frank P. Blando, called the meeting to order at 10:05am.

Chairman Frank P. Blando, read the Introductory Statement and called the roll call. Nine appellants and nine local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Craig C. Fishbein, Esq., Ms. Gudrun Johnson, Mr. M. Peter Kuck, Col. Kyle Overturf and Chief Carl Rosensweig.

Board Members Absent: Dr. S. David Bernstein and James A. Greer, Esq.

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings:

1) Case No. 14-636-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Desmond represented the local Issuing Authority, Chief William McKenna, Middletown Police Department. This case was continued from the September 11, 2014 hearing.

*Board Member, Col. Overturf recused himself from the case.

Decision: By a majority, the Board voted to uphold the decision of the local Issuing Authority, Chief William McKenna, Middletown Police Department, the denial of a temporary pistol permit. Board Member, Col. Overturf recused himself from the case. Board members Kuck and Rosensweig voted for the appellant, Board members Blando, Fishbein and Johnson voted for the local Issuing Authority.

2) Case No. 14-291-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Chief James Campbell, Thomaston Police Department, appeared as the local Issuing Authority.

Agreement: The appellant agreed to withdraw his appeal and the local Issuing Authority, Chief James Campbell, Thomaston Police Department, agreed to issue the permit immediately.

Motion: Board Member Fishbein made a motion to accept the agreement, Board Member Kuck seconded the motion, motion carried unanimously.

3) Case No.  14-053-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. A representative appeared for the local Issuing Authority, Chief Gerald Narowski, Derby Police Department.

Withdrawal: The appellant withdrew his appeal. Decision was for the local Issuing Authority by default.

4) Case No. 14-240-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. A representative appeared for the local Issuing Authority, Chief Jeffry Cossette, Meriden Police Department.

Withdrawal: The appellant withdrew his appeal. Decision was for the local Issuing Authority by default.

5) Case No. 13-521-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Kim Nikola represented the local Issuing Authority, Chief Joseph L. Gaudett, Bridgeport Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, Chief Joseph L. Gaudett, Bridgeport Police Department, the denial of a temporary pistol permit.

6) Case No. 14-342-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. A representative appeared for the local Issuing Authority, Chief John L. Salvatore, Monroe Police Department.

Withdrawal: The appellant withdrew his appeal. Decision was for the local Issuing Authority by default.

7) Case No. 13-490-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. A representative appeared for the local Issuing Authority, Chief Alan Baker, Danbury Police Department.

Withdrawal: The appellant withdrew his appeal. Decision was for the local Issuing Authority by default.

8) Case No. 14-398-CD, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. First Selectman Allan Cahill, Town of Hampton appeared as the local Issuing Authority.

Motion: Board Member Fishbein made a motion to find for the appellant once the appellant submits the fingerprints. Board Member Kuck seconded the motion, motion carried unanimously.

9) Case No. 14-396-CD, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. First Selectman Allan Cahill, Town of Hampton appeared as the local Issuing Authority.

Motion: Board Member Fishbein made a motion to find for the appellant once the appellant submits the fingerprints. Board Member Kuck seconded the motion, motion carried unanimously.

Board Member Fishbein made a motion to accept the September 11, 2014 minutes as written, Board Member Kuck seconded the motion, motion carried unanimously.
