BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Chairman Frank P. Blando, called the meeting to order at 10:00am.

Chairman Frank P. Blando, read the Introductory Statement and called the roll call. Six appellants were present. The State Issuing Authority was present and one local Issuing Authority was present and one local Issuing Authority failed to appear.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Craig C. Fishbein, Esq., Dr. S. David Bernstein*, James A. Greer, Esq., Ms. Gudrun Johnson, Mr. M. Peter Kuck, Col. Kyle Overturf and Chief Carl Rosensweig.

*Board Member Bernstein arrived at 10:16am and did not vote on the first two cases.

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings:

1) Case No. 14-024-R, involving the revocation of his pistol permit to carry pistols and revolvers. Attorney Ralph D. Sherman represented the appellant. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Agreement: The appellant agreed to withdraw the appeal and to show he had completed a gun safety course. The State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection represented by Sgt. D’Alessandro agreed to reinstate the permit immediately.

Motion: Board Member Fishbein made a motion to accept the agreement as stipulated, Board Member Kuck seconded the motion, motion carried unanimously.

2) Case No. 14-392-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. Attorney Ralph D. Sherman represented the appellant. Sgt. Andrew Dzierzgowski represented the local Issuing Authority, Chief Eric Osanitsch, Windsor Locks Police Department.

Motion: Board Member Fishbein made a motion in favor of the appellant and ordered a temporary pistol permit be issued to the appellant, Kuck seconded the motion, motion carried unanimously.

3) Case No. 14-191-R, involving the revocation of his pistol permit to carry pistols and revolvers. Attorney Leonard M. Crone represented the appellant. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, the revocation of the pistol permit.

4) Case No. 13-612-CD, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. A representative failed to appear for the local Issuing Authority, Chief Matthew Catania, Plainville Police Department.

Decision: By a unanimous decision, the Board voted for the appellant, by default, due to the local Issuing Authority’s representative for Chief Matthew Catania, Plainville Police Department, failure to appear. As a result the Board ordered a temporary pistol permit be issued to the appellant.

5) Case No. 14-117-R, involving the revocation of her pistol permit to carry pistols and revolvers. Attorney Ralph D. Sherman represented the appellant. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Agreement: The State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection and the appellant agreed that the pistol permit would be reinstated on May 19, 2015, on the condition of the completion of a gun safety course, the current suitability and that she hasn’t committed any offence that violates the criminal law and doesn’t have any statutory disqualifying events at that time.

Motion: Board Member Fishbein made a motion to accept the agreement as stipulated, Board Member Kuck seconded the motion, motion carried unanimously.

6) Case No. 14-173-R, involving the revocation of her pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a majority, the Board voted to overturn the decision of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection and ordered the reinstatement of the appellant’s pistol permit. Board Members Blando, Greer and Johnson voted for the State Issuing Authority. Board Members Bernstein, Fishbein, Kuck, Overturf and Rosensweig voted for the appellant.

Secretary’s Report:

Board Member Fishbein made a motion to accept the October 23, 2014 minutes as written, Board Member Overturf seconded the motion, motion carried unanimously.

New Business: Board Member Fishbein made a motion to accept the meeting schedule for 2015, Board Member Greer seconded the motion, motion carried.

Adjournment: Board Member Kuck made a motion to adjourn, Board Member Overturf seconded the motion, motion carried.
