BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Chairman Blando called the meeting to order at 10am.

Chairman Blando read the Introductory Statement.

Chairman Blando called the roll call. All ten appellants were present.

Eight local Issuing Authorities were present and two local Issuing Authorities were absent.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Craig C. Fishbein, Esq., Ms. Gudrun Johnson, Mr. M. Peter Kuck , Col. Kyle Overturf and Chief Carl Rosensweig.

Board Members Absent: Dr. S. David Bernstein, James A. Greer, Esq.

Chairman Blando administered the oath to all witnesses.

Hearings:

1) Case No. 14-143-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Chief James Kenny, Vernon Police Department, appeared as the local Issuing Authority with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, Chief James Kenny, Vernon Police Department, the denial of a temporary pistol permit.

2) Case No. 14-161a-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Town Manager Bruce Beneway, Town of Killingly represented the local Issuing Authority.

Motion: The appellant withdrew his appeal. Fishbein made a motion to accept the withdrawal, seconded by Kuck, motion carried unanimously.

3) Case No. 13-710-D, involving the denial of a pistol permit to carry pistols and revolvers. The appellant was represented by Attorney Daniel Dwyer. Lt. Donald Bisi represented the local Issuing Authority, Chief David A. Caron, Glastonbury Police Department.

Decision; By a tie vote, the Board voted to overturn the decision of the local Issuing Authority Chief David A. Caron, Glastonbury Police Department. A tie vote results in favor of the appellant and to issue a temporary pistol permit to the appellant. Johnson, Overturf and Rosensweig voted for the local Issuing Authority. Blando, Fishbein and Kuck voted for the appellant.

4) Case No. 14-131-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. First Selectman Ralph F. Eno the Town of Lyme for the local Issuing Authority.

Motion: The appellant withdrew his appeal. Fishbein made a motion to accept the withdrawal, seconded by Kuck, motion carried unanimously.

5) Case No. 14-154-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. The local Issuing Authority, First Selectman George R. Temple and or a representative from the Town of Oxford, failed to appear.

Motion: Fishbein made a motion to vote in favor of the appellant by default due to the local Issuing Authority’s failure to appear and voted for the appellant to be issued a temporary pistol permit. Kuck seconded the motion, motion carried.

6) Case No. 14-136-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Michael Dethlefsen represented the local Issuing Authority, Chief Vernon Riddick, Waterbury Police Department.

Motion: The appellant withdrew his appeal. Fishbein made a motion to accept the withdrawal, seconded by Kuck, motion carried unanimously.

7) Case No. 13-510-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Thomas Duncan represented the local Issuing Authority, First Selectman Richard Shuck, Town of Stafford Springs.

Motion: The appellant withdrew his appeal. Fishbein made a motion to accept the withdrawal, seconded by Kuck, motion carried unanimously.

8) Case No. 13-619-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf with one witness. Sgt. Jose Claudio represented the local Issuing Authority, First Selectman Lisa Pellegrini, Town of Somers.

Decision; By a tie vote, the Board voted to overturn the decision of the local Issuing Authority First Selectman Lisa Pellegrini, Town of Somers. A tie vote results in favor of the appellant and to issue a temporary pistol permit to the appellant. Fishbein, Johnson and Rosensweig voted for the local Issuing Authority, at this time. Blando, Kuck and Overturf voted for the appellant.

9) Case No. 14-135-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Det. Nivakoff represented the local Issuing Authority, Chief Dean Esserman, New Haven Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Chief Dean Esserman, New Haven Police Department, and to issue a temporary pistol permit to the appellant.

10) Case No. 14-166-CD, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. The local Issuing Authority, First Selectman Derrylyn Gorski and or a representative from the Town of Bethany, failed to appear.

Motion: Fishbein made a motion to vote in favor of the appellant by default due to the local Issuing Authority’s failure to appear and voted for the appellant to be issued a temporary pistol permit. Kuck seconded the motion, motion carried.

Secretary’s Report:

1) Fishbein made a motion to approve the March 13, 2014 minutes as written, Johnson seconded the motion, motion carried. Kuck abstained.
