Call to Order

Chairman Blando called the meeting to order at 10am.

Chairman Blando called the roll call. 7 appellants were present and 1 absent.

The State Issuing Authority was present and 1 local Issuing Authority was present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Craig C. Fishbein, Esq.,  Dr. S. David Bernstein, James A. Greer, Esq., Ms. Gudrun Johnson, Col. Kyle Overturf and Chief Carl Rosensweig.

Board Members Absent: Mr. M. Peter Kuck

Chairman Blando administered the oath to all witnesses.

Hearings:

1) Case No. 13-413-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Fishbein made a motion in favor of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, due to the appellant’s failure to appear. Motion seconded by Greer, motion carried unanimously.

2) Case No. 13-181-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf with one witness. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his appeal.

3) Case No. 13-495-R, involving the revocation of his pistol permit to carry pistols and revolvers. Attorney Ralph D. Sherman represented the appellant with 2 witnesses. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Continued: By order of the Board continued the case until June 27, 2013.

4) Case No. 13-493-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant notified the Board’s office, the day before the hearing, that he wants to withdraw his appeal and would not attend. The local Issuing Authority, Chief Thomas Kulhwik, Norwalk Police Department was informed of the appellant’s decision.

Withdrawal: The appellant withdrew his appeal prior to the hearing.

5) Case No. 13-439-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf.  Officer John Finnimore represented the local Issuing Authority, Chief Brent Larrabee, East Haven Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, Chief Brent Larrabee, East Haven Police Department, the denial of a temporary pistol permit.

6) Case No. 13-423-R, involving the revocation of his pistol permit to carry pistols and revolvers. Attorney Alicia Perillo represented the appellant. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his appeal.

7) Case No. 13-600-R, involving the revocation of his pistol permit to carry pistols and revolvers. Attorney Erin Field represented the appellant. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Fishbein made a motion to accept the stipulated agreement that the appellant will withdraw his appeal and the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, will issue the appellant the permit today. Greer seconded the motion, motion carried unanimously.

8) Case No. 13-412-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf with one witness. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to overturn the decision of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, and voted for the appellant to be reinstated his pistol permit.

9) Case No. 13-535-R, involving the revocation of his pistol permit to carry pistols and revolvers. Attorney Herman Woodard, Jr. represented the appellant. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, the revocation of the appellant’s pistol permit, at this time.

Secretary’s Report

1) Secretary Fishbein asked for a motion to approve the January 9, 2014 minutes. Greer seconded the motion, motion carried.  

Old Business: none

New Business: Secretary Fishbein wanted the Board members to know that the appeal cases were now scheduled into January 2016. Col. Overturf asked about the number of new appeals each year.  Office Manager, S. Mazzoccoli, stated that in Fiscal Year 2013, the Board received 700 new appeals and in prior years the Board had received between 300-400 appeals.  Office Assistant N. Lotas reported since July 1, 2013, Fiscal Year 2014, the Board has received 480 new appeals with 6 months left to go in the year.
