BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Chairman Frank P. Blando, called the meeting to order at 10:00am.

Chairman Frank P. Blando, read the Introductory Statement and called the roll call. Nine appellants were present. The State Issuing Authority and two local Issuing Authorities were present and one local Issuing Authority failed to appear.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Craig C. Fishbein, Esq., James A. Greer, Esq., Ms. Gudrun Johnson, Col. Kyle Overturf and Chief Carl Rosensweig.

Board Members Absent: Dr. S. David Bernstein and Mr. M. Peter Kuck.

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings:

1) Case No. 13-654-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, the revocation of the pistol permit.

2) Case No. 14-184-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. A representative appeared for the local Issuing Authority, First Selectman James Hayden, Town of East Granby. 

Withdrawal: The appellant withdrew his appeal.

3) Case No. 14-114-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, the revocation of the pistol permit.

4) Case No. 14-143-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. The local Issuing Authority, Chief Louis J. Fusaro, Norwich Police Department, or his representative failed to appear. 

Motion: Chairman Blando made a motion for the appellant, by default, due to the local Issuing Authority, Chief Louis J. Fusaro, Norwich Police Department, failed to appear, motion seconded by Blando, motion carried unanimously.

5) Case No. 14-182-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Chief Sean Cox, East Hampton Police Department represented the local Issuing Authority.

Motion: Fishbein made a motion for the appellant due to insufficient evidence; Blando seconded the motion for discussion purposes. Motion carried by a majority. Blando, Fishbein, Johnson, Overturf and Rosensweig voted for the motion and Greer voted against the motion.

6) Case No. 13-663-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, the revocation of the pistol permit.

7) Case No. 13-522-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a majority, the Board voted to overturn the decision of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, the revocation of the pistol permit. Blando, Fishbein, Johnson, Overturf and Rosensweig voted for the appellant. Greer voted for the Issuing Authority.

*Atty. Greer left early for an appointment.

8) Case No. 13-528-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, the revocation of the pistol permit, at this time.

9) Case No. 14-161b-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, the revocation of the pistol permit.

Secretary’s Report:

Fishbein called for a motion to accept the July 24, 2014 minutes as written, Johnson seconded the motion, motion carried. Overturf abstained.
