BOARD OF FIREARMS PERMIT EXAMINERS

Thursday, April 24, 2014, 12:00pm at the

DESPP, 1111 Country Club Rd., Middletown, CT 06457

Call to Order:

Chairman Blando called the meeting to order at 10:00am and read the Introductory Statement.

Chairman Blando called the roll call. 9 appellants were present and 1 was absent.

The State Issuing Authority was present and 2 local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Craig C. Fishbein, Esq.,  Dr. S. David Bernstein, Ms. Gudrun Johnson, Mr. M. Peter Kuck and Chief Carl Rosensweig.

Board Members Absent: James A, Greer, Esq. and Col. Kyle Overturf

Chairman Blando administered the oath to all witnesses.

Hearings:

1) Case No. 12-232-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf with one witness. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to overturn the decision of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, and ordered the reinstatement of the appellants pistol permit. 

2) Case No. 14-038-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. David Gannon represented the local Issuing Authority, Chief Mark Rinaldo, Avon Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Chief Mark Rinaldo, Avon Police Department and ordered the temporary pistol permit to be issued.

3) Case No. 14-033-D, involving the denial of a pistol permit to carry pistols and revolvers. The appellant failed to appear. A representative from the local Issuing Authority, Berlin Police Department, appeared on behalf of Chief Paul Fitzgerald.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, Chief Paul Fitzgerald., Berlin Police Department, by default, for the appellant’s failure to appear.

4) Case No. 14-017-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. A representative of the local Issuing Authority appeared on behalf of Town Manager Bruce Beneway, Town of Killingly.

Motion: Secretary Fishbein made a motion to accept the agreement of the appellant and the local Issuing Authority. The appellant agreed to withdraw his appeal and the local Issuing Authority agreed to issue the temporary pistol permit. Kuck seconded the motion, motion carried.

5) Case No. 14-023-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. Attorney Ralph D. Sherman represented the appellant. Det. James Held appeared for the local Issuing Authority, Chief Carl Sferrazza, Enfield Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Chief Carl Sferrazza, Enfield Police Department and ordered the temporary pistol permit to be issued.

6) Case No. 13-489-R, involving the revocation of her pistol permit to carry pistols and revolvers. Attorney Ralph D. Sherman represented the appellant. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a majority, the Board voted to overturn the decision of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection. Johnson voted for State Issuing Authority.  Bernstein, Blando, Fishbein and Kuck voted for the appellant. The Board ordered the State Issuing Authority to reinstate the appellant’s pistol permit.

7) Case No. 13-690-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf with one witness. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, the revocation of the appellants pistol permit.

8) Case No. 13-507-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, the revocation of the appellants pistol permit, at this time.

9) Case No. 13-720-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his appeal.

Secretary Fishbein left early due to a work emergency.

10) Case No. 14-264-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a majority, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection. Kuck voted for the appellant.  Bernstein, Blando, Johnson, and Rosensweig voted for the State Issuing Authority.  The Board voted to uphold the revocation of the appellants pistol permit, at this time.
